Common use of SITE PLAN AGREEMENT Clause in Contracts

SITE PLAN AGREEMENT. The following warning clauses may be required to be included in all offers of purchase and sale. The section of Site Plan Agreement that requires the clause is in italics in brackets. The Owner agrees to insert the following clause in the sale and purchase agreement for each dwelling within the Plan; "Students from this area may have to attend existing schools. Although a school site has been reserved in the area of the subject draft plan; a school may not be built for some time, if at all, and then only if the Ministry of Education and Training authorizes funding and construction of this required school." (Schedule E, 1) The Owner agrees to insert a notice in the agreement of purchase and sale for any lot in the advising the purchaser that mail delivery will be from a designated Community Mailbox. The Owner shall be responsible for advising each homeowner in the Plan as to the location of the Community Mailbox to be used by such homeowner. (Schedule E, 4)
