Site Location. This Power Purchase Agreement is Site specific as set forth in Section 1.01(b). Seller may, with SCE’s prior written consent, change the location of the Site; provided that, the Interconnection Point is not changed. Seller shall promptly provide a revised Exhibit 1 to the Final Notice to Proceed for the Generating Facility, attached hereto as Exhibit B, describing any new Site in the event Seller requests SCE’s consent to change the Site location.

The pricing is based on: easy access to site, firm and level ground, and a dry location. If during the course of the rental, rain occurs and the ground becomes unstable causing the tractor or trailer to become stuck, Customer will be responsible for additional charges to have the Equipment removed. Porta Kleen is not responsible for any damage caused to property when it follows the Customer’s direction on where to drive to set up the Equipment, except to the extent such damages are caused by Porta Kleen’s sole negligence.

Item Description Project location The project site begins at the intersection of Xxxxx Plantation Road and Knight Road and extends approximately 3,000 feet southeast toward Shipmans Cove Boulevard in Fort Bend County, Texas. Existing improvements Based on the aerial images, the site appears to be heavily wooded at the time of this cost estimate. The existing Watt Plantation Road pavement section consists of reinforced concrete. Based on the information provided by the client, the pavement right of way is 100 feet and a small creek runs through the site. We assumed the creek is a maximum of 6 feet deep. Current ground cover Heavily wooded. Existing topography Relatively level. Site access We expect the site and exploration locations are accessible with our all-terrain vehicle (ATV) mounted drilling equipment during normal business hours once pathways have been cleared.

Site Location. Dell will ship the Dell APEX System to the Site. The Dell APEX System (as defined in the APEX Agreement) cannot be deployed at ‘dark sites’, meaning locations that do not allow the Dell APEX System in the Dell APEX Service to connect with anyone outside of that location. Customer must allow Dell’s or Deployment Partner’s authorized technician access to the Site in a timely and secure manner for the following activities:
