Services During Construction. Attend a pre‐construction meeting with the Contractor and City to prepare for the project. Review and respond to requests for information from the Contractor. Services During Construction. Except as expressly stated in the Scope of Work, A/E shall not, and shall not be responsible to supervise, direct, or have control over the Work of CLIENT’s or Property Owner’s contractors, subcontractors, or other service or material providers, including any designated general contractor of CLIENT or Property Owner or any subcontractors thereof (generally and collectively referred to as the “Contractors”) nor have any responsibility for the construction means, methods, techniques, sequences, or procedures selected by the Contractors nor for the Contractors’ safety precautions or programs in connection with the Work. These above rights and responsibilities are solely those of and between CLIENT and the applicable Contractors. CLIENT agrees that A/E is not responsible for the job-site condition or on-site worker safety, except as otherwise expressly stated in the Scope of Work. Except where prohibited by applicable law, A/E shall not be responsible for any acts or omissions of the Contractors, including any subcontractor, any entity performing any portions of the Work or any agents or employees of any of them. A/E does not guarantee the performance of any of the Contractors and shall not be responsible for the Contractors’ failure to perform their applicable work in accordance with the Contract Documents or any applicable laws, codes, rules or regulations. As used in these Standard Conditions, the term “Contract Documents” refers to the construction plans, specifications, work schedules, work conditions and other matters between CLIENT and/or the Property Owner and their respective Contractors for the build-out or construction services relating to the Project. A/E shall not be required to sign any document, no matter by whom requested, that would result in A/E having to certify, guarantee, or warrant the existence of conditions whose existence A/E cannot reasonably ascertain. CLIENT agrees not to make resolution of any dispute with A/E or payment of any amount due to A/E contingent upon A/E signing any such document.
Services During Construction. 3.5.1 During construction, the CM/GC shall provide all services required by the Contract Documents of a General Contractor and Construction Manager. Specific details of the Services are provided below and in the sections of Division 00 General Conditions and Division 01 General Requirements of the Contract Documents but these details shall in no way limit the CM/GC’s overall duty to provide CM/GC services.
3.5.2 The Owner shall conduct Owner, Architect, CM/GC progress meeting(s) at least once every week. The CM/GC will hold separate weekly subcontractor meeting(s). All written minutes will be distributed to the CM/GC and the A/E within three (3) working day of each meeting. The CM/GC shall conduct site tours for the Owner and other officials as required.
3.5.3 The CM/GC shall prepare and update CPM construction progress schedules monthly in accordance with the Specifications at Section 01 32 00 Construction Progress Documentation.
3.5.4 The CM/GC shall be responsible for superintendence, to provide ongoing coordination between crafts, job site safety, quality control, settling disputes between subcontractors (Owner expects the CM/GC to negotiate with subcontractors but reserves the right to reject any subcontractor proposal), negotiating change proposals with the Owner, revising and forwarding submittals and Requests for Information (RFI’s) to the Owner’s Representative and A/E for action that are not resolvable from the contract documents, and for responding to all correspondence related to any activities that arise from a subcontractor’s inability or unwillingness to perform. In addition to the Project Executive Personnel, the CM/GC shall provide, as detailed below, at a minimum, a full‐time Superintendent, a full‐time Project Manager and the necessary field and office staff to support the Project.
3.5.5 The CM/GC shall employ a qualified Project Manager as proposed in the CM/GC’s proposal for the Project, with a minimum of ten (10) years of experience as a Project Manager in work of similar scope or scale, subject to Owner’s approval. The Project Manager shall be on the site of the Work as required during construction operations and have the authority to act on behalf of the CM/GC. The Project Manager shall manage and plan all activities of the Work. The Project Manager shall have demonstrated experience in managing and planning projects. Services During Construction. During this phase, Consultant will provide office and on-site engineering services in support of the City and General Contractor construction of the Biosolids Dryer improvements.
Services During Construction. The CONSULTANT will assist, as requested by the City, in the administration of the construction contract by reviewing and approving technical submittals, responding to RFI’s, issuing design directives, and evaluating proposed changes. Any construction inspection or testing provided by CONSULTANT is for the purpose of determining the Contractor's compliance with the functional provisions of the project specifications only. CONSULTANT in no way guarantees or insures Contractor's work nor assumes responsibility for methods or appliances used by the Contractor for job site safety or for Contractor's compliance with laws and regulations. CLIENT agrees that in accordance with generally accepted construction practices the construction Contractor will be required to assume sole and complete responsibility for job site conditions during the course of construction of the project including safety of all persons and property and that this responsibility shall be continuous and not be limited to normal working hours.
