Septic System Contingency. This Contract is contingent upon a satisfactory inspection of the septic system, including all components and leaching field(s) showing results that are satisfactory based on requirements published by the State of Connecticut or municipality in which the property is located, as applicable to the subject property, to be performed by a licensed septic system inspector. Buyer shall arrange and pay for the inspection. 🞏 Buyer 🞏Seller shall pay for digging associated with the inspection. 🞏 Buyer 🞏Seller shall pay for any cleaning or pumping of the septic system that is recommended by the inspector and/or that is required in order to perform the inspection. Seller shall pay for retrofitting the septic tank with a riser if a riser is required under the Connecticut Public Health Code (PHC). However, if the system has been pumped within six (6) months prior to the date of the inspection, Buyer shall pay to have the subsurface sewage disposal system pumped if necessary, to perform the inspection. A report of the inspection shall be completed within calendar days after the date that this contract is fully executed (Contingency Date). If the report reveals that the septic system is not in proper working condition, then Buyer shall immediately provide Seller with a copy of the entire report and any repair requests. If Seller and Buyer cannot come to a mutually satisfactory agreement concerning repairs to the septic system and any restoration of the leaching area needed as a result of such repairs, then Buyer may terminate this Contract by giving Seller and Broker written notice within five (5) calendar days of the Contingency Date above. Pursuant to section 19-13-B103d(b) of the PHC and Subsection X of the "Technical Standards for Subsurface Sewage Disposal Systems" published by the Commissioner of Public Health, discharges of wastewaters from water treatment systems (e.g., water softeners, iron or manganese removal filters) to surface waters, sanitary sewer systems, subsurface sewage disposal systems or to the ground surface are prohibited unless otherwise authorized by the Department of Energy and Environmental Protection (DEEP). ❒ Other tests or inspections deemed necessary by municipality, inspector or lender.

Septic System Contingency. This Agreement, and the obligations of Buyer, are subject to and contingent upon the Seller causing the septic tank or cesspool (as applicable) to be pumped by a qualified professional, and (check option which applies): having the tank and connections to the drainfield inspected and tested by a qualified professional to determine that, in the qualified professional's opinion, the system appears to be functioning normally and the drainfield appears to be readily accepting effluent; or having the septic system, including the connections from the house to the tank, and from the tank through the drainfield inspected and tested by a qualified professional to determine that, in the qualified professional's opinion, the connections from the house to the drainfield are freely flowing and appear to be in good operating condition, the system appears to be functioning normally and the drainfield appears to be readily accepting effluent. Unless otherwise agreed, Seller shall be solely responsible for any expenses incurred in connection with such pumping and testing.

  • PFPC System PFPC shall retain title to and ownership of any and all data bases, computer programs, screen formats, report formats, interactive design techniques, derivative works, inventions, discoveries, patentable or copyrightable matters, concepts, expertise, patents, copyrights, trade secrets, and other related legal rights utilized by PFPC in connection with the services provided by PFPC to the Fund.

  • Preventive Care and Early Detection Services This plan covers, early detection services, preventive care services, and immunizations or vaccinations in accordance with state and federal law, including the Affordable Care Act (ACA), as set forth below and in accordance with the guidelines of the following resources: • services that have an A or B rating in the current recommendations of the U.S. Preventative Services Task Force (USPSTF); • immunizations recommended by the Advisory Committee on Immunization Practices of the Centers for Disease Control and Prevention; • preventive care and screenings for infants, children, and adolescents as outlined in the comprehensive guidelines supported by the Health Resources and Services Administration (HRSA); or • preventive care and screenings for women as outlined in the comprehensive guidelines as supported by HRSA. Covered early detection services, preventive care services and adult and pediatric immunizations or vaccinations are based on the most currently available guidelines and are subject to change. The amount you pay for preventive services will be different from the amount you pay for diagnostic procedures and non-preventive services. See the Summary of Medical Benefits and the Summary of Pharmacy Benefits for more information about the amount you pay. This plan covers the following preventive office visits. • Annual preventive visit - one (1) routine physical examination per plan year per • Pediatric preventive office and clinic visits from birth to 35 months - 11 visits; • Well Woman annual preventive visit - one (1) routine gynecological examination per plan year per female member.

  • Crane Erection & Jumping (a) Cranes and man/material hoists may be erected, altered, climbed and dismantled during times when ordinary production works are in progress subject to the work being done in full compliance with a relevant operational safety zone (OSZ) plan which has been developed specifically for that operation with consideration to overall site safety. (b) The crane crew for each tower crane (Crane Crew) must consist of the following: (i) crane driver; and (ii) three (3) dogmen. (c) In addition to the appropriate tickets held by the crane driver and the dogmen, the following high risk licences must be held amongst the Crane Crew: (i) rigging; and (ii) material handling. (d) Where a Project consists of a single Crane Crew, the Employer should endeavour to ensure another member of the Crane Crew holds a crane driver licence.

  • Ambulance Escort Where a nurse is assigned to provide patient care for a patient in transit, the following provisions shall apply: i) Where a full-time nurse performs such duties during her or his regular shift, the full-time nurse shall be paid her or his regular rate of pay. Where a full-time nurse performs such duties outside her or his regular shift or on a day off, she or he shall be paid the appropriate overtime rate. ii) Where a part-time nurse performs such duties during an assigned shift, she or he shall be paid her or his regular rate of pay. Where a part-time nurse continues to perform such duties in excess of her or his assigned shift, she or he shall be paid the appropriate overtime rate. (b) Where such duties extend beyond the nurse's regular shift, the Hospital will not require the nurse to return to regular duties at the hospital without at least eight (8) hours of time off. Where such time off extends into the nurse's next regularly scheduled shift she or he will maintain her or his regular earnings for that full shift. (c) Hours spent between the time the nurse is relieved of patient care responsibilities and the time the nurse returns to the hospital or to such other location agreed upon between the Hospital and the nurse will be paid at straight time or at appropriate overtime rates, if applicable under Article 14. 01. It is understood that the nurse shall return to the hospital or to such other location agreed upon between the Hospital and the nurse at the earliest opportunity. Prior to the nurse's departure on escort duty, or at such other time as may be mutually agreed upon between the Hospital and the nurse, the Hospital will establish with the nurse arrangements for return travel. (d) The nurse shall be reimbursed for reasonable out of pocket expenses including room, board and return transportation and consideration will be given to any special circumstances not dealt with under the foregoing provisions. NOTE 1: (Note 1 applies to full-time nurses only) The Hospital agrees to continue to pay any greater monetary benefit for ambulance escort duty if such greater benefit has been paid by the Hospital immediately prior to this Agreement. This note applies at Hospitals where this superior condition exists as of December 14, 1987. NOTE 2: (Note 2 applies to part-time nurses only) The Hospital agrees to continue to pay any greater monetary benefit for ambulance escort duty if such greater benefit was paid by the Hospital under a Collective Agreement immediately prior to this Agreement. This note applies at Hospitals where this superior condition exists as of December 14, 1987.

  • Post-Accident Testing a. The City may require a Covered Employee who caused, or may have caused, an Accident, based on information known at the time of the Accident, to submit to drug and/or alcohol testing. b. Following an Accident, all Covered Employees subject to testing shall remain readily available for testing. A Covered Employee may be deemed to have refused to submit to substance abuse testing if the employee fails to remain readily available, including failing to notify a supervisor (or designee) of the Accident location, or leaving the scene of the Accident prior to submitting to testing. c. Nothing in this section shall delay medical attention for the injured following an Accident or prohibit an employee from leaving the scene of an Accident for the period necessary to obtain assistance in responding to the Accident or to obtain necessary emergency medical care. d. If the City requires a Covered Employee to be tested post-Accident, then the employee may ask for representation. Representation may include, but is not limited to, union representatives and shop stewards. If the employee requests representation, the City shall allow a reasonable amount of time from the time the employee is notified that the employee will be tested (a maximum of one hour) for the employee to obtain representation provided that the union representative meet the employee at the Accident site, work location or testing center as determined by the City. Such request shall not delay the administration of the tests for more than one hour from the time the employee is notified that the employee will be tested. e. As soon as reasonably possible after the occurrence of an Accident, the supervisor or other City representative at the Accident scene shall make best efforts to contact the Department of Human Resources (DHR) or designee, and DHR or designee shall then make best efforts to telephone the union(s) first designated representative on file with DHR representing the Covered Employee(s) involved in the Accident. If the first designated representative does not answer, DHR or designee shall leave a voice mail message notifying the union of the Accident and telephone the union(s) second designated representative on file with DHR. For purposes of this paragraph, a designated representative shall be any union officer or employee whose telephone number is on file with DHR for the purpose of Accident review. The union may change the designated representative, in writing, as necessary from time to time, but it is the sole responsibility of the union to ensure that a current telephone number (with voice mail capability) for two designated representatives are on file with DHR.
