Separate Determination Sample Clauses
The Separate Determination clause establishes that certain issues or disputes within a contract can be resolved independently from other matters. In practice, this means that if a disagreement arises over a specific aspect of the agreement, that issue can be addressed and decided upon without delaying or affecting the resolution of unrelated issues. This approach helps streamline dispute resolution by allowing parties to move forward on uncontested matters while a particular issue is being determined, thereby reducing potential bottlenecks and ensuring continued progress under the contract.
Separate Determination. For the following purposes, described in this Section 12.07(A), the Plan Administrator will determine separately a Participant's Compensation for each Participating Employer. Under this determination, except as provided below, Compensation from a Participating Employer includes Compensation paid by a Related Employer of that Participating Employer.
(1) Nondiscrimination and coverage. All of the separate tests listed in Section 12.05(A).
Separate Determination. For the following purposes, a Participant's Compensation shall be determined separately for each Participating Employer:
(1) Nondiscrimination and coverage. All of the separate tests listed in Section 14.5(a).
(2) Top-heavy. Application of the top-heavy rules in Article IX.
