Common use of Schedule of Performance Clause in Contracts

Schedule of Performance. City and Developer intend that the Project shall be developed pursuant to, and in accordance with, the milestones set forth in this Agreement.

Developer shall use commercially reasonable efforts to develop the Project in this Agreementaccordance with the Schedule of Performance, subject to extension by Force Majeure.

Developer shall use commercially reasonable efforts to develop Phase 1 of the Project in this Agreementaccordance with the Schedule of Performance.

City and Developer Builder intend that the Project shall be developed pursuant to, and in accordance with, the milestones set forth on the “Schedule of Performance” attached hereto as Exhibit C. Builder shall use commercially reasonable efforts to develop the Project in this Agreementaccordance with the Schedule of Performance.

Developer shall use commercially reasonable efforts to develop the Project in this Agreementaccordance with the Schedule of Performance.
