Common use of Royalty Period Clause in Contracts

Royalty Period. The royalty payments set forth in Section 4.2 shall be payable on a country-by-country basis from the date of First Commercial Sale of such Itraconazole Product in such country until the later of: (a) [**] years from the date of First Commercial Sale of such Itraconazole Product in such country; or (b) until the last to expire of any Valid Claim of an Itraconazole Patent Right in such country. During the period of time, if any, from the last to expire of any Valid Claim of an Itraconazole Patent Right in a country and the [**] anniversary of the date of First Commercial Sale of such Itraconazole Product in such country, the royalty rate shall be reduced by [**] percent ([**]%).
