Common use of Risk of Payments by Post Clause in Contracts

Risk of Payments by Post. Whenever payments are to be made or documents are to be sent to any Holder by the Trust, TCPL or the Exchange Trustee, or by such Holder to the Trust, TCPL or the Exchange Trustee, the making of such payment or sending of such document through the post shall be at the risk of the Trust, TCPL or the Exchange Trustee, as applicable, in the case of payments made or documents sent by the Trust, TCPL or the Exchange Trustee, as applicable, and the Holder, in the case of payments made or documents sent by the Holder.

Risk of Payments by Post. Whenever payments are to be made or documents are to be sent to any Holder by the Trust, TCPL or the Exchange Indenture Trustee, or by such Holder to the Trust, TCPL or the Exchange Indenture Trustee, the making of such payment or sending of such document through the post shall be at the risk of the Trust, TCPL or the Exchange Indenture Trustee, as applicable, in the case of payments made or documents sent by the Trust, TCPL or the Exchange Indenture Trustee, as applicable, and the Holder, in the case of payments made or documents sent by the Holder.
