Common use of Right of Property Clause in Contracts

Right of Property. The rights and privileges granted to Resident by this Agreement do not include any right, title or interest in any part of the Residence or other personal property, land, buildings, and improvements constituting the Facility, other than the right to receive services, including the occupancy of the Residence, as set forth in this Agreement. Execution of this Agreement and payment of the Entrance Fee does not constitute the transfer of any interest in real estate. All rights, privileges, or benefits under this Agreement shall be subordinate to any mortgage, deed of trust, or security interest on or in any of the land, premises, fixtures, equipment, or furnishings of the Facility, and to all amendments, modifications, replacements, or refinancing of any such documents. Resident agrees that, upon request, Resident will execute and deliver any document which is required by the Facility or by the holder of any such mortgage, deed of trust or security interest, to effect such subordination or give evidence of it.
