Common use of Right not prejudiced Clause in Contracts

Right not prejudiced. Despite clause 27.6, any adjudication of a Claim in respect of which the parties have not agreed and it has not otherwise been determined as to whether the Distributor indemnity in clause 26.8 applies will not prejudice the right of the Retailer or the Distributor (as applicable) to assert that the Distributor's indemnity in clause 26.8 does, or does not, apply.
