Common use of Review and Acceptance by the Department Clause in Contracts

Review and Acceptance by the Department. Prior to acceptance of the Letter of Credit, the Department reserves the right to review and give its acceptance of the Letter of Credit. Both the initial expense and the annual premiums on the Letter of Credit must be paid by Contractor. Failure to timely provide a Letter of Credit acceptable to the Department is a material breach of this Contract.
