Common use of Retention Out of Order Clause in Contracts

Retention Out of Order. An Education Assistant may be retained out of order by job title seniority when Education Assistants with greater seniority do not possess the necessary qualifications or competencies. The decision on qualification and competencies shall be made by the Executive Director of Human Resources and any Education Assistant who disagrees with his/her decision may use the grievance procedure to seek relief.
