Common use of Retention and Retrieval of Cards Clause in Contracts

Retention and Retrieval of Cards. If Card-Present Transaction then (a) Merchant shall use its commercially reasonable efforts, by reasonable and peaceful means, to retain or recover a Card upon receiving such instructions when making a request for Authorization or if Merchant has reasonable grounds to believe that the Card is counterfeit, fraudulent or stolen; (b) This obligation does not authorize a breach of the peace or any injury to persons or property and Merchant will hold Service Providers harmless from any claim in connection with the retention or recovery of a Card.
