Responsibility for Costs of Correction. 6.22.4.1 The CM shall pay all of the costs and damages associated with the correction of Defective Work and the recovery of schedule deficiencies under this Section 6.22. Those costs and damages may include, but are not limited to, the related fees and charges of contractors, engineers, architects, attorneys, and other professionals; and the cost of correcting or replacing adjacent work. The Contracting Authority may deduct those costs and damages from payments then or thereafter due the CM. If payments then or thereafter due the CM are not sufficient to cover those amounts, the CM shall immediately pay the amount of the insufficiency to the Owner.
