Common use of Required Facility Documents Clause in Contracts

Required Facility Documents. All Required Facility Documents are listed on Exhibit 3.2.9, are held by MMC and are valid and in full force and effect with any applicable appeal periods having expired. Pursuant to the Required Facility Documents, MMC holds as of the Effective Date, or will hold by the Commercial Operation Date, and covenants that it will hold during the Term, all rights and entitlements necessary to own and operate the Facility and to perform its duties under and deliver Net Output to PPM in accordance with this Agreement. No unusual or burdensome conditions are expected by MMC to be placed upon, or created by, any of the Required Facility Documents and the anticipated operation of the Facility complies with all applicable restrictive covenants affecting the Premises and all Requirements of Law.
