Common use of Requests to Use Drug-Detection Canines Clause in Contracts

Requests to Use Drug-Detection Canines. It is understood and agreed that all inspections of lockers, desks, or other objects or personal property on school grounds involving the use of law enforcement drug-detection canines shall be conducted in accordance with the policies and procedures established in the New Jersey School Search Policy Manual; shall comply with the “Special Rules and Procedures Governing the Use of Law Enforcement Canines to Conduct Suspicionless Examinations” set forth in Chapter 4.5 F of that manual; and shall conform to N.J.A.C. 6A:16-6.2(b)5vi. No such operation shall be undertaken without the express permission of the county prosecutor or the Director of the Division of Criminal Justice or his or her designee in the New Jersey Department of Law and Public Safety. It is further understood and agreed that the (designated school official) shall not invite or approve the use of a privately-owned drug-detection canine without first providing notice of the intention to use any such private service to the (law enforcement agency) and the county prosecutor, and it is further understood and agreed that if any such private drug-detection canine alerts to the presence of a controlled dangerous substance, any substance, paraphernalia, or other evidence of an offense seized by any person pursuant to such alert shall be turned over to (law enforcement agency) or the County Prosecutor’s Office in accordance with the provisions of Articles 3.2 and 3.4 of this Agreement.
