REPRESENTATION AND ASSOCIATION SECURITY. 2.01 All references to Officers, Representatives, Committee Members in this Agreement shall be deemed to mean employees of the Corporation who are Officers, Representatives and Committee Members of Public Health, Ontario Nurses’ Association. 2.02 The Corporation agrees to recognize the following representatives of the Association: (a) A Negotiating Committee which shall be composed of a total of four (4) representatives from each of the parties, one of whom shall be the Commissioner of Human Resources or designate, and one whom shall be the ONA Labour Relations Officer. (b) A Grievance Committee which shall be composed of not more than three (3) Association members; (c) Two (2) representatives at each of the Corporation’s various worksites where members of the Association are employed to assist nurses in the presentation of any complaints or grievances that may arise, if the Nurse Representative's assistance is required by the aggrieved nurse. (d) A Nurse Management Committee composed of four (4) representatives of each of the parties, one of whom shall be the Commissioner of Human Resources or designate and one of whom shall be the Bargaining Unit President or designate. The function of this committee will be to promote and provide effective and meaningful communication of information and ideas on matters of mutual concern. The Committee shall meet at mutually satisfactory times, but not less than once every three (3) months. Agendas will be exchanged five (5) working days in advance of the meeting. It is agreed that grievances and/or negotiations will not be discussed at these meetings. The duties of the Chairperson and Recording Secretary shall be rotated through the members of the Committee. (e) An Occupational Health and Safety Committee which shall be established in accordance with the provisions of the Occupational Health and Safety Act. The Committee shall hold monthly meetings as required and all unsafe, hazardous or dangerous conditions affecting staff shall be taken up and dealt with at such meetings. Meetings shall take place at times mutually agreeable to all parties except in case of an emergency. All time spent by Nurses fulfilling their responsibilities on this Committee shall be considered time worked and paid in accordance with this Agreement. 2.03 The Association shall have the right at any time to have the assistance of a representative or consultant of the Ontario Nurses' Association. 2.04 The Association will provide the Corporation with the names of its officers, committee members and nurse representatives and shall keep such list up-to- date at all times. 2.05 The Association acknowledges that the nurse representatives and the committee members from among the nurses will be required to efficiently perform their regular duties on behalf of the Corporation and that such nurses will not leave their regular duties without first obtaining permission from their Program Manager or her/his designate to leave such regular duties and will report back to their Program Manager or her/his designate upon resuming their regular duties. (a) Nurse representatives and committee members as provided for in Article 2.01 will be paid their respective salaries for all time spent during regular working hours attending meetings with the Corporation. For those attending grievances, pay will be kept whole up to, but not including Grievance Mediation and Arbitration. The parties have the right to decline grievance mediation on a without prejudice basis for reasons of financial constraints. For negotiations, the Negotiating Committee shall have their pay kept whole, up to but not including, Conciliation and any other Negotiating meetings agreed to between the parties. (b) If either party submits a dispute to Arbitration, that party remains responsible to ensure the proper notice of cancellation is provided to the Arbitrator(s), in writing, with a copy to the other party. Failing which, said party will be solely responsible for any costs incurred. 2.07 The parties agree that there shall be no discrimination practiced against any nurse, in accordance with the Ontario Human Rights Code. (a) The Corporation will deduct from the pay of each nurse covered by this Agreement such monthly dues as may be adopted and designated by the Association. The Corporation will send to the Association once each month, its cheque for the dues deducted under this clause, accompanied by a report listing nursing staff from whom payroll deductions are being made, including Social Insurance Numbers for each nurse, and will also list additions or deletions to the list. (b) The Association shall notify the Corporation of any change in the amount of such dues. (c) The Association shall indemnify and save the Corporation harmless with respect to all dues so deducted and remitted. 2.09 The Corporation agrees to acquaint new nurses with the fact that a Collective Agreement is in effect, and with the conditions of employment set out in the articles. 2.10 The Corporation shall notify the President or her/his designate of a new nurse(s') commencement date of employment. The President or her/his designate shall be given a reasonable period of time to meet the new nurse(s) and provide her/him with a copy of the Collective Agreement.

Each party will notify the other at least seventy-two (72) hours in advance of the matters it wishes to place on the agenda for the meeting. A representative of the Ontario Nurses’ AssociationAssociation and/or a resource person of the Employer’s choice may attend a meeting of this Committee where mutually agreed. 2.02 3.02 The Corporation Employer agrees to recognize the following representatives of the Association: (a) A Negotiating Committee which shall be composed of a total of four three (43) nurse representatives from each who are members of the parties, one Bargaining Unit for the purpose of whom shall be negotiating for the Commissioner renewal of Human Resources or designate, and one whom shall be the ONA Labour Relations Officer.Collective Agreement; (b) A Grievance Committee which shall be composed of not more than three two (32) Association membersnurse representatives who are members of the Bargaining Unit for the purpose of attending grievance meetings as hereinafter provided for; (c) Two no more than two (2) nurse representatives at each of the Corporation’s various worksites where who are members of the Association are employed Bargaining Unit to assist nurses in the presentation of any complaints or grievances that may arise, if in accordance with the Nurse Representative's assistance is required by the aggrieved nurseprovisions hereinafter set forth. The Association agrees to provide the Employer with a current list up-to- date at all timesof the Executive. 2.05 3.04 The Association acknowledges that the nurse representatives and the committee Committee members from among the nurses will be required referred to efficiently above must continue to perform their regular duties and that so far as possible, all of their activities will be carried on behalf outside the regular working hours of the Corporation and that such nurses will employees concerned unless otherwise mutually arranged. If it is necessary for a designated nurse representative to service a grievance during her working hours, she shall not leave their regular duties her work without first obtaining the permission from their Program Manager or her/his designate to leave such regular duties and will of her Supervisor. Such permission shall not be unreasonably withheld. Upon completion of her activities, she shall report back to their Program Manager or her/his designate upon resuming their regular duties. (a) Nurse her Supervisor. In view of the foregoing understanding, nurse representatives and committee Committee members as provided for in Article 2.01 referred to above will be paid at their respective salaries regular straight time hourly rate of pay for all such time when it is spent attending necessary meetings with representatives of the Employer during the nurse representatives’ regular scheduled working hours. In no event will such members receive overtime compensation while on any union business unless such union overtime activities are associated with the Occupational Health and Safety Act. It is agreed further that this Article does not cover time spent during regular working hours attending at arbitration. 3.05 A representative of the Ontario Nurses’ Association and/or a resource person of the Employer’s choice may attend meetings with the Corporation. For those attending grievances, pay will be kept whole up to, but not including Grievance Mediation and Arbitration. The Employer will send to the Association once each month, month (within fifteen (15) days from the date the deductions were made) its cheque for the dues deducted under this clause, accompanied by a report listing nursing staff from whom payroll deductions are being made, including Social Insurance Numbers for each nurse, and will also list additions or deletions to the list. (b) The Association shall notify the Corporation of any change in the amount of such dues. (c) . The Association shall indemnify and save the Corporation Employer harmless with respect to all dues so deducted and remitted. 2.09 The Corporation agrees to acquaint . In the case of new nurses employees, the Employer will provide the Association with the fact that a Collective Agreement is in effectSocial Insurance Number and address of such new employees, and which information will be sent along with the conditions Employer’s cheque for the month in which dues were first deducted from such new employees. *In the case of employment set out newly employed nurses, such dues shall commence in the articles. 2.10 The Corporation shall notify the President or her/his designate of a new nurse(s') commencement month following their date of employment. The President or her/his designate shall be given a reasonable period of time to meet the new nurse(s) and provide her/him with a copy of the Collective Agreementhire.
