Common use of Replacement Work Clause in Contracts

Replacement Work. If an employee is incapable to perform his or her regular work due to an illness or injury, the employer can offer replacement work that the employee is capable of performing without compromising his or her health. Before starting the replacement work, the employer must find out, together with the employee and occupational health care services, whether the replacement work is suitable for the employee. The replacement work shall be appropriate and, if possible, similar to the employee’s regular duties. Instead of replacement work, vocational training can be arranged for the employee.
