Common use of REPAIR BY LESSEE Clause in Contracts

REPAIR BY LESSEE. Lessee will at its cost provide janitorial and housekeeping services, maintenance and repair for the Premises, and will perform all future improvements at its sole cost. Notwithstanding the sentence immediately above, the obligation of Lessee to repair and maintain the Premises shall be limited to maintenance and repair of the interior of the Premises and shall not include the roof, exterior walls or structural aspects of the Premises except in the event that any such damage is caused by or results from the negligence of Lessee or its agents or employees, in which event Lessee shall be obligated to make such repairs. In addition, Lessee shall have no obligation to replace the Premises (exclusive of the Telephone and Television Equipment) in the event of partial or complete destruction of the Premises. In addition to the above, Lessee shall at its cost maintain and repair any and all HVAC equipment servicing the Premises, provided that such equipment serves only the Premises and not other portions of the Project. To the extent of any warranty on HVAC equipment serving only the Premises, Lessor shall cooperate with Lessee to enforce the warranty obligations of the manufacturer and/or installer.
