Common use of Recovery of Grant Funds Clause in Contracts

Recovery of Grant Funds. Any Grant Funds disbursed to Grantee under this Agreement that are expended in violation of one or more of the provisions of this Agreement, including any Grant Funds used for ineligible or unauthorized expenditures as determined by a state or federal review for which Grant Funds have been claimed and payment received, (“Misexpended Funds”) must be returned to Agency. Grantee shall return all Misexpended Funds to Agency no later than fifteen (15) days after ODOT’s written demand.

Recovery of Grant Funds. Any Grant Funds funds disbursed to Grantee under this Agreement that are expended in violation or contravention of one or more of the provisions of this Agreement, including any Grant Funds used for ineligible Agreement or unauthorized expenditures as determined by a state that remain unexpended on the earlier of termination of this Agreement or federal review for which Grant Funds have been claimed and payment received, (“Misexpended Funds”) the Project Completion Date must be returned to Agency. Grantee shall return all Misexpended Funds to Agency no the Board not later than fifteen (15) 15 days after ODOTthe Board’s written demand.
