Common use of Recordation Report Clause in Contracts

Recordation Report. No later than the fifth Business Day of each third month, commencing the fourth month following the month in which the Closing Date for a Series occurs, the Trustee shall deliver to the Servicer a Recordation Report for such Series, dated as of the first day of such month, identifying those Mortgage Loans underlying such Series for which it has not yet received (A) an original recorded Mortgage or a copy thereof certified to be true and correct by the public recording office in possession of such Mortgage or (B) an original recorded Assignment of the Mortgage to the Trustee and any required intervening Assignments or a copy thereof certified to be a true and correct copy by the public recording office in possession of such Assignment; provided, however, that the Trustee shall not be required to provide a Recordation Report with respect to the recordation of an Assignment for any Mortgage Loan for which there has been delivered an Assignment in recordable form pursuant to Section 2.03(a) hereof unless the Trustee has delivered such Assignment to the Servicer for recordation, in which case, the Trustee shall deliver a Recordation Report as to the status of such Assignment in accordance with this paragraph commencing in the fourth month following the delivery of such Assignment to the Servicer for recordation.

No later than the fifth Business Day of each third month, commencing the fourth month following the month in which the Closing Date for a Series occursJanuary 1998, the Indenture Trustee shall deliver to the Servicer a Recordation Report for such Series, recordation report dated as of the first day of such month, identifying those Mortgage Loans underlying such Series for which it has not yet received (A1) an original recorded Mortgage or a copy thereof certified to be true and correct by the public recording office in possession of such Mortgage or (B2) an original recorded Assignment of the Mortgage to the Indenture Trustee and any required intervening Assignments or a copy thereof certified to be a true and correct copy by the public recording office in possession of such Assignment; provided, however, that the Indenture Trustee shall not be required to provide a Recordation Report recordation report with respect to the recordation of an Assignment for any Mortgage Loan for which there has been delivered an Assignment in recordable form pursuant to Section 2.03(a2.02(a) hereof unless the Indenture Trustee has delivered such Assignment to the Servicer for recordation, in which case, case the Indenture Trustee shall deliver a Recordation Report recordation report as to the status of such Assignment in accordance with this paragraph commencing in the fourth month following the delivery of such Assignment to the Servicer for recordation.
