The Association recognizes that when vacancies occur during the school year, it may be difficult to fill them from within the District without undue disruption of the existing instructional program. E. As vacancies occur, teachers will be notified via electronic posting.
F. When a teacher’s request for transfer is denied, he/she shall be no less than teninformed as soon as possible.

Any assignments in addition to the normal teaching schedule during the regular school year, including adult education courses, summer school courses, and extra duties, enumerated in Appendix B and C, shall not be obligatory but shall be with the consent of the teacher. Music teachers shall be obligated to assume Appendix C duties when they are integrated with classroom instruction.
H. All teachers regularly employed in the St. ▇▇▇▇▇ Public Schools shall be given first priority for appointment to extra duty under Appendix B and C if qualifications such as experience, knowledge, and ability to further the program are similar. Positions under Appendix B and C shall be filled on a voluntary basis with recommendation from the building principal and approval of the Board of Education. Assignment of the extra duties will be made annually at the discretion of the Board following a written evaluation of the previous year’s performance in the activity. QUALIFICATIONS AND ASSIGNMENTS. A. No teacher shall be employed by the Board for a regular teaching assignment who does not hold appropriate State Certification or meet the requirements set forth by the No Child Left Behind Act of 2001. A teacher hired before the first student attendance day of the 2002-2003 school year who is required by the ESEA to be ‘highly qualified’ (as defined by the ESEA and MDE) for his/her teaching assignment shall satisfy one of the options provided through the MDE in becoming ‘highly qualified’ by the end of the 2005-2006 school year.
B. A teacher who is required as of the end of the 2005-2006 school year by the ESEA to be ‘highly qualified’ (as defined by the ESEA and the MDE) for his/her teaching assignment and is not ‘highly qualified’ for his/her teaching assignment shall be granted the first vacancy he/she applies for provided he/she is ‘highly qualified’ for the vacancy. If there is no vacancy for which said teacher is ‘highly qualified’, said teacher shall be treated under Article XVI – Layoffs and Recall provisions of this Master Agreement as if his/her current position had been eliminated. A teacher that has been recognized as ‘highly qualified’ under the ESEA by this school district or another Michigan school district for his/her assignment shall be recognized as ‘highly qualified’ by this school district for the duration of his/her agreement.
C. The Administration shall provide each individual teacher with a statement of reasonable assurance of employment for the following school year, two (2) weeks before the end of the current school year. All teachers shall be given written notice of their class schedules for the forthcoming year no later than one week before the supply order or text deadline, or May 15th whichever comes first, of the school year. In the event that changes in such schedules are proposed, all teachers affected shall be notified promptly in writing and consulted. When special teachers, excluding remedial reading and math teachers, are unable to report for work, the administration will make every attempt to hire substitute teachers for the necessary time to ensure adequate planning time for elementary teachers. Teachers will be paid thirty-five dollars ($35) per instructional period when substituting teaching during their pre period.
5. Filing vacancies in extracurricular positions on Appendix B shall be done in the following manner:
a. If there is more than one (1) applicant from within the last day bargaining unit (and no outside applicants apply), the position shall be awarded to the most qualified applicant. Most qualified applicant as determined in the Board’s sole discretion.
