Common use of PROVIDED PRODUCTS AND SERVICES WARRANTIES Clause in Contracts

PROVIDED PRODUCTS AND SERVICES WARRANTIES. Each component of the Services, as well as any hardware provided by Contractor pursuant to this Agreement (a “Product”) is warranted by Contractor (whether or not Contractor is the manufacturer or developer of the Product) to be free from defect and will operate and perform as represented by Contractor for the greater of (i) one hundred eighty (180) days from the completion of the Services; or (ii) the period covered by any manufacturer’s warranty (the “Warranty Period”). In the event a Product does not operate as required during the Warranty Period, Contractor will replace, deliver, and (if applicable) install a replacement Product at no cost to the Institution. If the defective Product cannot be effectively replaced, Contractor shall provide a refund to the Institution.
