Property Description; Survey. (a) In consideration of the rents and covenants to be paid and performed by Tenant under the GRA and this Lease Agreement, Landlord does hereby grant, demise, and lease unto Tenant, the premises depicted in Exhibit 1 attached hereto (the “Site”), for the purpose of constructing, owning, and operating the RNG Plant. The Site is situated on the Landfill property. The Site is leased by Landlord to Tenant subject to any easements granted to Tenant hereunder.

Property Description; Survey. (a) In consideration of the rents and covenants to be paid and performed by Lessee under the LFG Agreement, Lessor does hereby grant, demise, and lease unto Lessee, the premises depicted in Exhibit A attached hereto (the “Site”), for the sole purpose of constructing, owning, and operating the Lessee’s Facilities. The Site is located on and/or adjacent to the Arlington Landfill located at 000 Xxxxxx Xxxxxx Road (at Highway 157) in Arlington, Texas (the “Landfill”) and within the boundaries of the premises subject to the LFG Agreement. The Site is leased to Lessee in “as-is, where-is” condition, and Lessee accepts the Site in its current condition and with all faults. Subject to the terms and conditions of the LFG Agreement, Lessor shall have no obligation to make any improvements to the Site before or during the term of this Lease.

  • Property Description A document prepared as an exhibit for the conveyance of a property interest, reflecting a boundary survey, signed and sealed by a Registered Professional Land Surveyor (RPLS), attached to an acquisition deed as Exhibit A, and consists of the following two (2) parts:

  • Survey Buyer may obtain a survey of the Property before the Closing to assure that there are no defects, encroachments, overlaps, boundary line or acreage disputes, or other such matters, that would be disclosed by a survey ("Survey Problems"). The cost of the survey shall be paid by the Buyer. Not later than business days prior to the Closing, Buyer shall notify Seller of any Survey Problems which shall be deemed to be a defect in the title to the Property.
