Common use of Prohibition from Participation in Future Solicitation Clause in Contracts

Prohibition from Participation in Future Solicitation. (s) A Vendor, or a Contractor or its subsidiary or subcontractor ("Vendor/Contractor"), is prohibited from submitting a SOQ or proposal in a County solicitation if the Vendor/Contractor has provided advice or consultation for the solicitation. A Vendor/Contractor is also prohibited from submitting a SOQ or proposal in a County solicitation if the Vendor/Contractor has developed or prepared any of the solicitation materials on behalf of the County. A violation of this provision will result in the disqualification of the Vendor/Contractor from participation in the County solicitation or the termination or cancellation of any resultant County Master Agreement.

(s) A VendorProposer, or a Contractor or its subsidiary or subcontractor Subcontractor ("VendorProposer/Contractor"), is prohibited from submitting a SOQ bid or proposal in a County solicitation if the VendorProposer/Contractor has provided advice or consultation for the solicitation. A VendorProposer/Contractor is also prohibited from submitting a SOQ bid or proposal in a County solicitation if the VendorProposer/Contractor has developed or prepared any of the solicitation materials on behalf of the County. A violation of this provision will result in the disqualification of the VendorContractor/Contractor Proposer from participation in the County solicitation or the termination or cancellation of any resultant County Master Agreementcontract.

A Vendor/Contractor is also prohibited from submitting a SOQ bid or proposal in a County solicitation if the Vendor/Contractor has developed or prepared any of the solicitation materials on behalf of the County. A violation of this provision will result in the disqualification of the Vendor/Contractor from participation in the County solicitation or the termination or cancellation of any resultant County Master Agreement. This provision shall survive the expiration, or other termination of this Master Agreement.
