Product or Service Liability. Since January 1, 2013, there has been no claim, suit, action, proceeding or investigation by or before any Governmental Entity pending or, to Company’s Knowledge, threatened against or involving any Acquired Company relating to Company Products.

Product or Service Liability. There is no action, suit, proceeding or to Company’s Knowledge, inquiry or investigation, by or before any court or Governmental Authority pending or, to Company’s Knowledge, threatened against or involving Company relating to any services performed by Company and alleged to have been defective or improperly rendered or not in compliance with contractual requirements, or any products or software delivered or sold by Company which are alleged to be defective or not in compliance with contractual requirements.

Before January 1, 2008, and since January 1, 2006, to the knowledge of the Sellers, there has been no claim, suit, action, proceeding or investigation by or before any Governmental Authority pending or threatened against or involving Scient’x or any of its Subsidiaries relating to any of the matters set forth in clauses (i) or (ii) above.
