Common use of Prime Broker Clause in Contracts

Prime Broker. Only a credit institute, a regulated investment company or another entity may be mandated. Such a prime broker will be subject to regulatory oversight and constant monitoring and will offer services to professional investors in order to primarily finance or carry out transactions with financial instruments as a counter-party, and will possibly offer other services such as the clearing and settlement of transactions, custodianship services, securities lending and customised technologies and facilities for business support. A prime broker may be appointed by the depositary as a sub-depositary, or by the AIFM as a business partner.
