Primary Assignment Clause Samples

The Primary Assignment clause establishes the main obligation for one party to transfer or assign certain rights, interests, or responsibilities to another party under the agreement. Typically, this clause specifies what is being assigned—such as intellectual property, contractual rights, or duties—and may outline any conditions or procedures required for the assignment to be effective. Its core practical function is to ensure that the intended transfer of rights or obligations is clearly authorized and legally binding, thereby preventing disputes over ownership or responsibility.
Primary Assignment. ‌ Any bargaining unit employee will be informed in writing of any major change in the employee’s assigned job description for the next year no later than five (5) days before the end of the student school year. Changes shall not be made in an arbitrary or capricious manner. Subsequent changes identified and necessary due to changes in student needs or staff will also be done in writing promptly to the employee by the employee’s Principal/ Supervisor. Employees may request and will be notified of the changes that require any alteration in an assigned job description in a timely manner. Employees who are assigned to act in the role and capacity of another employee during another employee’s absence for two (2) weeks or more shall not be subject to either progressive discipline or adverse impact on the employee’s final summative evaluation for incomplete work tasks for the position for which the employee is originally hired during the time the employee assists in the second role. Where feasible, administrators shall continue to rotate the assignment of other duties among employees on an equitable basis and in a manner that is not arbitrary and capricious. Notwithstanding the first statement in this paragraph, both parties agree that administrators may assign other work duties in order to achieve the School District’s Strategic Plan goals.
Primary Assignment. Upon date of hire, the District shall provide the employee with a letter informing the employee that their employment is subject to the terms of the Faculty Association collective bargaining agreement. The District shall assign employees based on their qualifications and District need. The letter shall include the following: 1. Effective date of hire; and 2. One or more disciplines from the Disciplines List except for faculty placed on Salary Schedule 60 (SS#60); and, 3. A primary assignment as defined in this article and service area as appropriate; and 4. The appropriate faculty service area (FSA) per Article 15 for their assignment(s); and 5. An employment status of either probationary (tenure track), regular (tenured) or temporary full time; and 6. Initial salary schedule placement and overload schedule placement.
