Common use of Preserved Performances Clause in Contracts

Preserved Performances. ‌ The Engager may express the possibility of recording or broadcasting the production for which the Artist has been engaged and the Artist may agree to participate in such a recording or broadcast by means of a rider to the Artist's contract. Such a possibility shall in no way be binding upon the Engager and is solely intended to make the Artist aware that such a possibility exists. However, negotiations for payment for a recording or broadcast may take place when the Equity contract is negotiated and signed. The Engager may not offer the Artist a contract for a recording of any kind except by means of an appropriate ACTRA/UBCP contract according to the terms of Clause 38:07.
