Common use of PRE-CONSTRUCTION PHASE SERVICES Clause in Contracts

PRE-CONSTRUCTION PHASE SERVICES. Construction Contractor shall provide the following review and commentary services, in addition to any other Pre-Construction Phase Services required by the terms of this Contract: 8.1 Review, Recommendations and Warranty: Construction Contractor shall familiarize itself thoroughly with the evolving architectural, civil, mechanical, plumbing, electrical and structural plans and specifications and shall follow the development of design from Schematic Pre-Construction Phase through Construction Documents Phase (as those phases are defined in the Design Agreement). Construction Contractor shall make recommendations with respect to the selection of systems and materials, and cost-reducing alternatives including assistance to Design Professional and Owner in evaluating alternative comparisons versus long term cost effects. The evaluation shall address the benefits of the speed of erection and early completion of the Work. Construction Contractor shall furnish pertinent information as to the availability of materials and labor that will be required. Construction Contractor shall submit to Owner and Design Professional such comments as may be appropriate concerning construction feasibility and practicality. Construction Contractor shall call to Owner’s and Design Professional’s attention any defects in the design, drawings and specifications or other documents of which it is aware. Construction Contractor shall prepare estimates of the construction cost utilizing the unit quantity survey method in the CSI format. These estimates shall be performed at the completion of the Program Verification Phase and shall be called the Program Estimate, followed by a Schematic Design Estimate, which shall be followed by the Design Development Estimate, which shall be followed by a 50% Construction Document Estimate, which shall be followed by the setting of the GMP.

Construction Contractor acknowledges that accurate construction cost estimates are critical to Owner’s ability to establish and verify its budget for the Project and, therefore, Construction Contractor shall work closely with Design Professional and use its best skill and judgment as a 50% Construction Document Estimate, which shall be followed by contractor familiar with the setting construction industry in the locality of the GMPProject in preparing its construction cost estimates.

The pre-construction phases during which Contractor is to provide Pre-Construction Document EstimatePhase Services are identified and generally described as outlined below (which descriptions shall not be deemed to limit Pre-Construction Phase Services required by other provisions of the Contract Documents). Minimum pre- construction deliverables are specified in Exhibit L: 8.1.1 Program Verification / Schematic Design Phase. Design Professional will review Owner’s program documents in order to ascertain the requirements of the Project, and either meet the design requirements set forth therein or submit a written request for variance, identifying specific exceptions, and submit a report on the program and other documents for Owner’s review and approval. Construction Contractor, based on exploratory activities, facilities condition assessments, and other investigation and analysis, shall provide Owner with value engineering, cost estimates, constructability analysis, and other services, and shall consult and coordinate with Design Professional with respect to development of Project construction cost estimates and an overall Project schedule and provide comments and recommendations concerning the Project design. To the extent Construction Contractor’s suggestions or recommendations with respect to the Project design are approved in writing by Owner, and are practicable and consistent with good design, Design Professional will endeavor to incorporate them into the Project design. Based upon the mutually agreed-upon Project program, schedule and budget by Owner and Design Professional, and after taking into consideration the comments and recommendations from Construction Contractor, Design Professional will prepare Phase I - Schematic Design Documents, as defined in and in compliance with the OCPS Design Guidelines for approval by Owner. Construction Contractor shall continue providing Owner with value engineering, cost estimating, and constructability review services, and further consult and coordinate with Design Professional concerning development of Project construction cost estimates and the overall Project schedule and provide comments and recommendations concerning the Project design. Additionally, Construction Contractor shall provide Owner and Design Professional input regarding alternative approaches to ongoing or subsequent phasing of design and construction services to achieve the best schedule and optimal cost for construction. At completion of the Schematic Design Phase, Design Professional will submit Schematic Design Documents for Owner’s Project Manager’s review and comment, which Construction Contractor shall be followed by the setting of the GMPalso review and comment upon.

Construction Contractor shall make recommendations with respect to the selection of systems and materials, and cost-reducing alternatives including assistance to Design Professional and Owner in evaluating alternative comparisons versus long term cost effects. The evaluation shall address the benefits of the speed of erection and early completion of the Work. Construction Contractor shall furnish pertinent information as to the availability of materials and labor that will be required. Construction Contractor shall submit to Owner and Design Professional such comments as may be appropriate concerning construction feasibility and practicality. Construction Contractor shall call to Owner’s and Design Professional’s attention any defects in the design, drawings and specifications or other documents of which it is aware. Construction Contractor shall prepare estimates of the construction cost utilizing the unit quantity survey method in the CSI format. Construction Contractor Manager shall make recommendations with respect to the selection of systems and materials, and cost-reducing alternatives including assistance to Design Professional and Owner in evaluating alternative comparisons versus long term cost effects. The evaluation shall address the benefits of the speed of erection and early completion of the Work. Construction Contractor Manager shall furnish pertinent information as to the availability of materials and labor that will be required. Construction Contractor Manager shall submit to Owner and Design Professional such comments as may be appropriate concerning construction feasibility and practicality. Construction Contractor Manager shall call to Owner’s and Design Professional’s attention any defects in the design, drawings and specifications or other documents of which it is aware. Construction Contractor Manager shall prepare estimates of the construction cost utilizing the unit quantity survey method in the CSI format. These estimates shall be performed at the completion of the Program Verification Phase and shall be called the Program Estimate, followed by a Schematic Design Estimate, which shall be followed by the Design Development Estimate, which shall be followed by a 50% Construction Document Estimate, which shall be followed by the setting of the GMP. These estimates shall be performed at or as otherwise detailed in a specific preconstruction scope attachment or exhibit.
