Position Upon Return to Work Clause Samples

The "Position Upon Return to Work" clause defines an employee's right to be reinstated to their previous job or an equivalent position after returning from a leave of absence, such as medical or parental leave. Typically, this clause outlines whether the employee will return to the exact same role, with the same pay and benefits, or to a comparable position if the original job is unavailable. Its core function is to protect employees from losing their employment status or suffering demotion due to taking approved leave, thereby ensuring job security and compliance with employment laws.
