Common use of Poor Maintenance Performance Clause in Contracts

Poor Maintenance Performance. To the extent that Poor Maintenance Performance occurs at any time, the Department may request the Development Entity to take such actions as may reasonably be required in order to ensure that the reasons for the relevant Noncompliance Event are adequately mitigated with a view to ensuring that in the reasonably foreseeable future, there is no reasonable prospect of a Noncompliance Event occurring for the same reasons.
