PMC. Sierra hereby retains Peerless for the Development, and Peerless hereby accepts retention for the Development, in accordance with the terms and conditions of this Agreement.
PMC. The PMC project team combines decades of experience working with local governments on new policy issues, environmental compliance, sustainability, and public outreach. We are a unique solution to the unique problem of climate change. The PMC project team has relevant, recent, and credible experience in all task areas needed for completion of the Milpitas Qualified GHG Emissions Reduction Strategy/Climate Action Plan (CAP). With multiple climate action plans in progress or complete, most of which are structured as CEQA tiering documents, we will bring a wealth of experience in climate action planning to this project. Xxxxxxx Xxxxxx, Principal in Charge Xx. Xxxxxx is an associate principal at PMC and oversees the company’s environmental services. He also serves as a project director and manager for a variety of projects. Xx. Xxxxxx will also be providing technical guidance throughout the project and will help to ensure that the CAP positions the City to transition into completion of the General Plan SEIR. Xx. Xxxxxx will also provide senior quality control review of all PMC work products. He specializes in environmental and urban land use planning and has performed tasks for projects such as water and wastewater facilities, energy facilities, flood control projects, residential subdivisions, mixed-use urban developments, and redevelopment plans. Xx. Xxxxxx’x experience includes preparing urban land use and growth analysis, recreation and visual resource studies, public services assessment, transportation and circulation studies, and cultural resource analysis. He has also been involved in the preparation of several CEQA and NEPA documents and technical studies and has over 16 years of environmental documentation preparation experience. He has conducted a variety of integrated climate action planning and CEQA documents.
PMC. City Council approval of this DA would replace the City Hearing Examiner’s normal role in acting upon the otherwise-required CUP and variances. In addition, the City recognizes the public benefits that will accrue to the City and community from redevelopment of the property for the Project. Public benefits of the project include improved access to the existing Sounder Puyallup Station for drivers, pedestrians, and bicyclists. The new garage includes approximately 500 parking spaces (for a total of 1,252 spaces in the immediate station area) that benefit the transit riders who travel from the region to access the Sounder system. For those riders who access the station by bicycle or by foot, non-motorized improvements - including sidewalks, pedestrian lighting, and bicycle improvements will be constructed. The non-motorized improvements are also a benefit to those who live and work in the immediate area.

Any issue not addressed in this agreement shall be subject to normal processes and approvals as provided in Puyallup Municipal Code and City Design Standards. In addition, the City recognizes the public benefits that will accrue to the City and community from redevelopment of the property for the Project. Public benefits of the project include improved access to the existing Sounder Puyallup Station for drivers, pedestrians, and bicyclists. The project provides a new surface parking area of approximately 165 spaces and a new garage including approximately 500 parking spaces (for a total of approximately 1,031 spaces in the immediate station area. Additional parking is available via bus service.) that benefit the transit riders who travel from the region to access the Sounder system. For those riders who access the station by bicycle or by foot, non‐motorized improvements ‐ including sidewalks, pedestrian lighting, and bicycle improvements will be constructed. The non‐motorized improvements are also a benefit to those who live and work in the immediate area.
PMC. The City hereby agrees to combine the requirement for a Conditional Use Permit with this Agreement because the City Council held a public hearing on this Agreement, this Agreement contains such reasonable conditions as necessary to ensure the Project’s review and siting satisfies the City’s land use approval criteria and procedures outlined in Chapter 20.80 PMC, and the development agreement process has met all applicable procedural requirements. Sound Transit’s letter documenting fulfillment of the development standards outlined in PMC 1.15.020 is included below.

  • Verizon OSS Services Access to Verizon Operations Support Systems functions. The term “Verizon OSS Services” includes, but is not limited to: (a) Verizon’s provision of Reconex Usage Information to Reconex pursuant to Section 8.1.3 below; and, (b) “Verizon OSS Information”, as defined in Section 8.1.4 below.

  • Developer Developer shall construct and complete, in a good and workmanlike manner, the Work for the Guaranteed Maximum Price including any adjustment(s) to the Guaranteed Maximum Price pursuant to provisions herein regarding changes to the Guaranteed Maximum Price. Except as otherwise noted, Developer shall provide and pay for all labor, materials, equipment, permits (excluding DSA), fees, licenses, facilities, transportation, taxes, bonds and insurance, and services necessary for the proper execution and completion of the Work, except as indicated herein.

  • Franchisee A “franchisee” is a retailer or distributor who is authorized or permitted, under a franchise, to use a trademark in connection with the sale, consignment, or distribution of motor fuel.

  • Supplier A manufacturer, fabricator, distributor, supplier, or vendor of goods or equipment in connection with the Work, or any other party having a Contract or Purchase Order with the Contractor or with a Subcontractor to furnish materials or equipment to be incorporated in the Work by the Contractor or a Subcontractor.

  • Vendor upon request and without further consideration, shall perform any acts that may be deemed reasonably necessary or desirable by Customer to evidence more fully the transfer of ownership and/or registration of all Intellectual Property Rights in all Work Product to Customer to the fullest extent possible, including but not limited to the execution, acknowledgement and delivery of such further documents in a form determined by Customer. In the event Customer shall be unable to obtain Vendor’s signature due to the dissolution of Vendor or Vendor’s unreasonable failure to respond to Customer’s repeated requests for such signature on any document reasonably necessary for any purpose set forth in the foregoing sentence, Vendor hereby irrevocably designates and appoints Customer and its duly authorized officers and agents as Vendor’s agent and Vendor’s attorney-in-fact to act for and in Vendor’s behalf and stead to execute and file any such document and to do all other lawfully permitted acts to further any such purpose with the same force and effect as if executed and delivered by Vendor, provided however that no such grant of right to Customer is applicable if Vendor fails to execute any document due to a good faith dispute by Vendor with respect to such document. It is understood that such power is coupled with an interest and is therefore irrevocable. Customer shall have the full and sole power to prosecute such applications and to take all other action concerning the Work Product, and Vendor shall cooperate, at Customer’s sole expense, in the preparation and prosecution of all such applications and in any legal actions and proceedings concerning the Work Product.

  • Consultant Services 4.1 The Consultant agrees to perform the following services and undertake the following responsibilities and duties to the Company to be provided by the Consultant to the Company as consulting services (the "Consulting Services"):

  • Provider If the Provider is a State Agency, the Provider acknowledges that it is responsible for its own acts and deeds and the acts and deeds of its agents and employees. If the Provider is not a State agency, then the Provider agrees to indemnify and save harmless the State and its officers and employees from all claims and liability due to activities of itself, its agents, or employees, performed under this contract and which are caused by or result from error, omission, or negligent act of the Provider or of any person employed by the Provider. The Provider shall also indemnify and save harmless the State from any and all expense, including, but not limited to, attorney fees which may be incurred by the State in litigation or otherwise resisting said claim or liabilities which may be imposed on the State as a result of such activities by the Provider or its employees. The Provider further agrees to indemnify and save harmless the State from and against all claims, demands, and causes of action of every kind and character brought by any employee of the Provider against the State due to personal injuries and/or death to such employee resulting from any alleged negligent act by either commission or omission on the part of the Provider.

  • Program Manager Owner may designate a Program Manager to administer the Project and this Contract. In lieu of a Program Manager, Design Professional may be designated to perform the role of Program Manager. The Program Manager may also be designated as the Owner’s Representative, and if no Owner’s Representative is designated, the Program Manager shall be the Owner’s Representative.
