The Permanent Night Shift clause establishes that certain employees are assigned to work exclusively during nighttime hours on an ongoing basis. This clause typically outlines the specific hours that constitute the night shift, eligibility criteria for assignment, and any additional compensation or benefits provided for night work. Its core function is to formalize the arrangement of continuous night work, ensuring both employer and employee have clear expectations and obligations, and to address operational needs that require staffing outside of regular daytime hours.
Permanent Night Shift an Employee who (except at their own request pursuant to clause 7.8.2;
(a) During a period of engagement on shift, works night shift only; or
(b) Remains on a night shift for a longer period than four successive weeks; or
(c) Works on a night shift which does not rotate or alternate with another shift or with day work so as to give the Employee at least one third of their working time off night shift in each cycle; must, during such engagement, period or cycle be paid their ordinary time hourly rate plus 30% for all time worked during ordinary hours on such night shift.
Permanent Night Shift. If a night shift, being a period of duty finishing after midnight and at or before 5.30 am, does not rotate or alternate with another shift or day work, then a permanent night shift loading of 30% of the ordinary hourly rate for the appropriate classification will be paid for all hours worked. Provided that where a part-time employee is in receipt of this loading they will not also be entitled to be paid the 15% allowance provided for in sub-clause 25.1.
Permanent Night Shift. Subject to the operational requirements of the business, the Company will have the capacity to introduce a permanent night shift. If introduced, the permanent night shift will involve work carried out during the evening and will be conducted between the hours of 5.00pm and 5.00am, subject to seasonal darkness. Time worked will be paid at the rate of 130% based on the employee’s ordinary rate of pay.
Permanent Night Shift. An employee who: • during a period of engagement on shift, works night shift only; or • remains on night shift for a longer period than four consecutive weeks; or • works on a night shift which does not rotate or alternate with another shift or with day work so as to give the employee at least one third of their working time off night shift in each shift cycle, must, during such engagement, period or cycle, be paid 30% extra for all time worked during ordinary working hours on such night shift. The rate at which a shift worker must be paid for work on a weekend or public holiday is: • time and a half on a Saturday; • double time on a Sunday; and • double time and a half on a public holiday. Where shifts commence between 11.00pm and midnight on a Sunday or public holiday, the time so worked before midnight does not entitle the employee to the Sunday or public holiday rate for the shift. However, the time worked by an employee on a shift commencing before midnight on the day proceeding a Sunday or public holiday and extending into the Sunday or public holiday must be regarded as time worked on the Sunday or public holiday. Where shifts fall partly on a holiday, the shift which has the major portion falling on the public holiday must be regarded as the holiday shift.
Permanent Night Shift. An Employee (including a casual Employee) permanently working ordinary rostered hours of work which finish on the day after commencing duty or commence after midnight and before 4.59 am (inclusive), shall be paid a shift allowance as set out in Schedule D for any such period of duty. ‘Permanently working’ shall mean working for more than four consecutive weeks.
Permanent Night Shift. Grade 1: In year one of the Agreement, a Grade 1 employee engaged on permanent night shift shall receive a minimum hourly rate of $25.94.
Permanent Night Shift. Permanent Night Shift is a night shift which does not rotate or alternate with another shift or with day work so as to give the employee at least 1/3rd of working time off night shift in each shift cycle. Permanent Night Shift will only apply to employees other than Casual employees and those employees that are rostered on as a Permanent Night Shift employee shall be entitled to an hourly rate as detailed in Attachment Two of this agreement, which is inclusive of a 5% loading for all hours the employee works under a Permanent Night Shift roster.
Permanent Night Shift. 23.5.3.1 Permanent Night Shift means any work performed in a roster cycle in which not less than 2/3 of the Employees total ordinary hour shifts include hours worked between the span of hours from 12 midnight and 6.00am on any day of the week irrespective of whether or not the said ordinary hour shift commences before or ends after this specified span of hours.
Permanent Night Shift. (a) An employee who, as required by the Company:
(i) during a period of engagement on shift, works night only; or
(ii) remains on night shift for a period longer than four (4) consecutive weeks; or
(iii) works on a night shift which does not rotate or alternate with another shift or with day work so as to give them at least one-third of their working time off night shift in each shift cycle, will be paid a ‘double shift allowance’ per shift.
(b) The following ‘double shifts allowances’ will be paid from the first full pay period to commence on or after the dates set out below: 1 July 2023 1 July 2024 1 July 2025 Double Shift Allowance (per shift) $ 73.37 $ 76.31 $ 78.60 For the purposes of this subclause "Night Shift" means a shift finishing subsequent to midnight and at or before 8.00a.m.
Permanent Night Shift. 24.14.1 An employee who (except at his/her own request pursuant to 24.2.1 hereof) during a period of engagement on shift, works night shift only; or
24.14.2 Remains on a night shift for a longer period than four successive weeks; or
24.14.3 Works on a night shift which does not rotate or alternate with another shift or with day work so as to give him/her at least 1/3rd of his/her working time off night shift in each cycle; shall during such engagement, period or cycle be paid 30% more than his/her ordinary rate for all time worked during ordinary working hours on such night shift.
