Performance during Claim Resolution Process. The Contractor shall diligently proceed with Work on the Project at the same time that Claims are addressed under this Article. It is the intent of District to resolve Disputes with the Contractor as close to the events giving rise to the Disputes as possible, and to avoid stale or late Claims and the late documenting of Claims. Contractor’s failure to diligently proceed in accordance with the District’s instructions or the Contract terms will be considered a material breach of this Agreement and a waiver of Contractor’s rights under this Agreement.
