PENALTY FOR NON-COMPLIANCE TO TECHNICAL SPECIFICATIONS AND STANDARDS. For failure to comply with the technical specifications and standards as to any of the required parameters, such as but not limited to materials, design, fittings, etc. set by MCWD, a penalty of ten percent (10%) of the Contract Price per cubic meter of the Minimum Volume shall be imposed to BWS until such time that the defect will be corrected.
