Common use of Payment Policy Clause in Contracts

Payment Policy. All boarding pet fees MUST be paid before Pet is released to the Pet Owner. If fees ARE NOT paid, Pet will NOT be released. Pet Owner is responsible for paying the boarding full fee, whether the boarding stay is shortened or the boarding stay is lengthened. Owner understands that extra charges may be added to the bill at discretion of management for special handling or treatment that is above and beyond routine care. Special handling is defined as services beyond our standard boarding care due to behavior problems, health, or other unexpected care not anticipated at time of check in. Owner agrees to pay all such charges. All checks returned for non-sufficient funds will be charged a fee of $35.00. Initial CHECK IN/CHECK OUT Monday-Saturday CHECK IN/OUT times are 8:00a-11:00a, and 4:00p-7:00p. Sunday hours are 8:00-11:00 am for DEPARTURES only, and 4:00-7:00pm for ARRIVALS AND DEPARTURES. If Pet is picked up during the 4:00p-7:00p pick up time on the departure day, Pet Owner will be charged the full amount for a full day of boarding. Pet Owner may be a charged an off-hour pick-up/drop-off fee of $20 when arriving at any other time for any reason. There is no CHECK IN/OUT hours on holiday days. Initial RESERVATION + CANCELLATION FEES Pet Owners are required to provide a major credit card to be placed on file for all boarding reservations. If less than a 48-hour notice is given for a cancellation or a no-show of a reservation, a minimum $75 non-refundable cancellation fee will be charged to the credit card on file. Initial PHOTO/VIDEO I hereby xxxxx Xxxxxxxxx LTD, the right and permission to use any photographs/video taken of me or my pets for any purpose and in any and all media now of in the future. Initial I hereby xxxxx Xxxxxxxxx LTD, the right and permission to use my name in connection with the photographs or videos if so chosen. Initial ABANDONED DOG PROCEDURE Unless otherwise required by applicable law, if you fail to pick up your dog(s) by the designated time and have failed to make satisfactory alternative arrangements with Stonehill Kennel and Farm, Stonehill will continue to provide basic service to ensure the dog’s health and safety, and charges will continue to accrue. Stonehill will make best efforts to contact you using the information you provided, advising you that if your dog(s) is not picked up within a reasonable time period, your dog(s) will be deemed to be abandoned and that Stonehill will deliver the dog(s) to a third-party adoption partner or other reputable animal welfare organization. You understand that you may lose ownership of your dog(s) under these circumstances. If you fail to pick up your dog(s) for any reason, you release Stonehill from all further liability and responsibility for your dog(s). You shall remain liable to Stonehill Kennel and Farm, for all unpaid charges, including without limitation the court costs and reasonable attorneys’ fees incurred in the collection of such charges. Initial REPRESENTATIONS + LIABILITY ● I agree that I am the owner (or designated agent of the owner) of the dog(s) and am fully authorized to enter this agreement. ● I understand and agree that Xxxxxxxxx Kennel and Farm is relying on my representations of my dog’s (dogs’) health and behavior. I further understand and agree that Stonehill Kennel and Farm and its staff will not be liable for any health problems that develop. I agree and understand that Xxxxxxxxx Kennel and Farm reserves the right to deny admittance to my dog(s) at any time for any reason. ● I understand and agree that Stonehill Kennel and Farm will not be liable for any injuries or illnesses that occur as a result of my dog(s) attendance, provided that reasonable care and precautions are followed. ● I understand that group exercise and group play are situations where dogs co-mingle in groups, and if I have given permission to Stonehill Kennel and Farm to allow my dog(s) to participate in any group activity. I understand and acknowledge that there are inherent risks when dogs co-mingle, including, but not limited to, bites, scratches and sore muscles. ● I understand that Stonehill Kennel and Farm is not a veterinary establishment and does not practice veterinary medicine. I understand and agree that if my dog(s) become ill or injured, or if the state of the dog(s) health requires medical attention, Stonehill Kennel and Farm, in its sole discretion, may engage the services of a veterinarian and/or administer medicine or give other requisite attention to the dog. Stonehill Kennel and Farm staff will make their best efforts to notify me in the event of a serious illness or injury using the contact information I have provided to Stonehill Kennel and Farm. I understand that I am responsible for providing updated contact information. I agree to assume full financial responsibility for any and all expenses incurred, and I release Stonehill Kennel and Farm, and its staff from any and all responsibility for, or claims, damages, debts, arising out of or related to such medical care, including, but not limited to, transportation to/from the veterinary clinic and choice of veterinarian and animal hospital. ● I certify, to the best of my knowledge, my dog(s) has not been exposed to any communicable diseases with the past 30 days. I agree that I will notify Stonehill Kennel and Farm of any known exposure of my dog(s) to communicable diseases and will keep my dog(s) out of playcare and will provide a veterinary certification of fitness for playcare to be admitted or readmitted. I also agree that I will maintain current vaccines for my dog(s) and provide certification to that effect upon initial evaluation and periodically as requested. ● I authorize Xxxxxxxxx Xxxxxx and Farm to obtain medical and vaccination records for my dog(s) from my veterinarian, and I hereby authorize my veterinarian to provide these records to Stonehill Kennel and Farm. I understand and agree that I am solely responsible for any and all acts or behavior of my dog(s) while in the care of Stonehill Kennel and Farm. I release Stonehill Kennel and Farm from any liability arising from my dog(s) attendance at Stonehill Kennel and Farm and accept full responsibility for any and all costs for injury to staff or other animals or damage to facilities caused by my dog(s). I hereby release Stonehill Kennel and Farm of any liability and I further agree to indemnify and save them harmless against any and all claims arising from my dog(s) attendance at Stonehill Kennel and Farm, including but not limited to all costs, damages attorneys fees, expenses and liabilities in connection therewith. ● I understand that in an emergency event, such as a natural disaster, every effort will be made to contact me to retrieve my dog(s). I agree that Stonehill Kennel and Farm, in its sole discretion, is authorized to transport and/or make temporary alternative arrangements to house and care for my dog(s) until I retrieve my dog(s). ● I understand and agree that my dog(s) may be photographed, videotaped and/or recorded and that Stonehill Kennel and Farm retains all rights to use, and proceeds from use of, images. ● I understand that this agreement covers the current relationship between Stonehill Kennel and Farm and me. Each time I bring my dog(s) to Stonehill Kennel and Farm, I am affirming the terms of this Agreement and the truthfulness and accuracy of all statements I make in this Agreement. I have read and understand this entire agreement, I have had an opportunity to discuss it to my satisfaction with a representative of Stonehill Kennel and Farm, and I agree to its terms.

Payment Policy. All boarding pet fees MUST Fifty percent (50%) of the *initial deposit of the room rental fee is due at the time the CLIENT enters into this Agreement. This is required as an initial deposit. The remaining balance of the rental fee and a $300 refundable *damage deposit is due no less than thirty (30) days prior to start of the event. Main Street Junction accepts payments in the form of credit card (Visa or MasterCard) or check payable to "The City of Union-MSJ". *Initial deposit = 50% of room rental *Damage deposit = $ 300.00 CLIENT agrees to these payment terms. CLIENT Initials CANCELLATION POLICY CLIENT must provide a dated, written request for cancellation. Upon cancellation by CLIENT the following fee schedule will apply: 18 MONTHS - 12 MONTHS------------------------100% Minus $100 Administrative Fee 12 MONTHS - 6 MONTHS------------------------50% or $100 Administrative Fee (Whichever is Greater, Will be paid before Pet charged) 6 MONTHS- 0 MONTHS------------------------0% * If the event is released cancelled less than 30 days prior, the full rental payment will not be refunded. No refunds will be made when the event is canceled by Main Street Junction due to the Pet OwnerCLIENT's noncompliance with terms and conditions. If fees DATE CHANGES ARE NOT paidTR EATED AS CANCELLATIONS Reservations are booked when the renter submits a signed facility use contract and fifty- percent (50%) of the rental fee. Balance is due 30 days prior to the event. Please read the schedule above to understand the percentage of the initial rental fee deposit that will be refunded of the booking is cancelled. All cancellations must be made in writing. No refund will be made when the event is canceled by Main Street Junction due to the CLIENT'S noncompliance with terms and conditions. DAMAGE DEPOSIT Damage deposit of $300 is due thirty (30) days prior to your rental period. Damage deposits will be returned via check, Pet usually within one (1) week following the event. Deductions may be made for damage, excessive cleaning, or time used beyond the contracted period. CLEAN-UP RESPONSIBILITIES Clean-up is the CLIENT's responsibility. CLIENT is expected to provide sufficient supervision to minimize spillage of food and beverages on the Facility floors during the rental event. Any CLIENT leaving excessive trash in the main hall, kitchen, restrooms, l obby, and/or outside of doors is subject to additional charges. All or a portion of the damage deposit will NOT be releasedwithheld if the Facility is not adequately cleaned, or if damage occurs. Pet Owner CLIENT must finish the clean-up no later than the time the CLIENT has identified as the ending time for his/her event. Main Street Junction will provide additional trash liners if needed. All decorations must be taken down and removed from the Facility. CLIENT is responsible for all kitchen clean-up. The kitchen area must be thoroughly cleaned and returned to its original level of cleanliness. This includes all work areas, refrigerator, sinks and floors. CLIENT will be made to contact me to retrieve my dog(s). I agree that Stonehill Kennel in charge of clean up and Farm, in its sole discretion, is authorized to transport and/or make temporary alternative arrangements to house and care for my dog(s) until I retrieve my dog(s). ● I understand and agree that my dog(s) may be photographed, videotaped and/or recorded and that Stonehill Kennel and Farm retains all rights to use, and proceeds from use of, images. ● I understand that this agreement covers the current relationship between Stonehill Kennel and Farm and me. Each time I bring my dog(s) to Stonehill Kennel and Farm, I am affirming the terms removal of this Agreement and the truthfulness and accuracy of all statements I make in this Agreement. I have read and understand this entire agreement, I have had an opportunity to discuss it to my satisfaction with a representative of Stonehill Kennel and Farm, and I agree to its termsdecorations.

Any exhibitor or sponsor who cancels all purchased booth space or sponsorships after August 4, 2015 will forfeit and pay to CCC, as liquidated damages, a sum of money equal to 100% of the full price of said exhibitor’s exhibit space or sponsorship. In the event of a default by the exhibitor or sponsor, as set forth in the previous sentence, the exhibitor or sponsor shall forfeit as liquidated damages, the amount set forth above, regardless of whether Show Management enters into a forth lease for the space involved. Cancellation requests must be paid before Pet is released submitted, in writing, to the Pet OwnerExhibits Manager. The exception to this cancellation policy is any sponsored item which includes a logo which may already be in production and which order cannot be cancelled with the producing vendor. LOGO RECOGNITION Company agrees to submit company logo to the Exhibits Manager (XXXxxxxxxxx@xxxxxxxxxxxxxxxxxx.xxx) via email within 1 week of signing this agreement form. Any exhibitor or sponsor who cancels all purchased booth space or sponsorships after August 4, 2016 will forfeit and pay to CCC, as liquidated damages, a sum of money equal to 100% of the full price of said exhibitor’s exhibit space or sponsorship. In the event of a default by the exhibitor or sponsor, as set forth in the previous sentence, the exhibitor or sponsor shall forfeit as liquidated damages, the amount set forth above, regardless of whether Show Management enters into a forth lease for the space involved. Cancellation requests must be paid before Pet is released submitted, in writing, to the Pet OwnerExhibits Manager. The exception to this cancellation policy is any sponsored item which includes a logo which may already be in production and which order cannot be cancelled with the producing vendor. LOGO RECOGNITION Company agrees to submit company logo to the Exhibits Manager (XXXxxxxxxxx@xxxxxxxxxxxxxxxxxx.xxx) via email within 1 week of signing this agreement form. If fees ARE NOT paidthe company changes logo at any point, Pet company will NOT be releasednotify Exhibit Manager immediately and send the new logo. Pet Owner is responsible for paying the boarding full fee, whether the boarding stay is shortened or the boarding stay is lengthened. Owner understands that extra charges may be added Due to the bill at discretion of management for special handling or treatment that is above and beyond routine care. Special handling is defined as services beyond our standard boarding care due to behavior problems, health, or other unexpected care not anticipated at production time of check in. Owner agrees to pay all such charges. All checks returned for non-sufficient funds will certain items, if a logo change occurs, it is not guaranteed that the time can be charged a fee of $35.00. Initial CHECK IN/CHECK OUT Monday-Saturday CHECK IN/OUT times are 8:00a-11:00a, and 4:00p-7:00p. Sunday hours are 8:00-11:00 am for DEPARTURES only, and 4:00-7:00pm for ARRIVALS AND DEPARTURES. If Pet is picked up during the 4:00p-7:00p pick up time on the departure day, Pet Owner will be charged the full amount for a full day of boarding. Pet Owner may be a charged an off-hour pick-up/drop-off fee of $20 when arriving at any other time for any reason. There is no CHECK IN/OUT hours on holiday days. Initial RESERVATION + CANCELLATION FEES Pet Owners are required to provide a major credit card to be placed on file for all boarding reservations. If less than a 48-hour notice is given for a cancellation or a no-show of a reservation, a minimum $75 non-refundable cancellation fee will be charged to the credit card on file. Initial ABANDONED DOG PROCEDURE Unless otherwise required by applicable lawPlease check with the Exhibit Manager for individual items’ production times. AUTHORIZATION By signing this Agreement, if you fail to pick up your dog(s) by the designated time and have failed to make satisfactory alternative arrangements with Stonehill Kennel and Farm, Stonehill will continue to provide basic service to ensure the dog’s health and safety, and charges will continue to accrue. Stonehill will make best efforts to contact you using the information you provided, advising you that if your dog(s) is not picked up within a reasonable time period, your dog(s) will be deemed to be abandoned and that Stonehill will deliver the dog(s) to a third-party adoption partner or other reputable animal welfare organization. You understand that you may lose ownership of your dog(s) under these circumstances. If you fail to pick up your dog(s) for any reason, you release Stonehill from all further liability and responsibility for your dog(s). You shall remain liable to Stonehill Kennel and Farm, for all unpaid charges, including without limitation the court costs and reasonable attorneys’ fees incurred in the collection of such charges. Initial REPRESENTATIONS + LIABILITY ● I agree that I am have read the owner (or designated agent of the owner) of the dog(s) and am fully authorized to enter this agreement. ● I understand above guidelines and agree that Xxxxxxxxx Kennel and Farm is relying on my representations of my dog’s (dogs’) health and behavior. I further understand and agree that Stonehill Kennel and Farm and its staff will not be liable for any health problems that develop. I agree and understand that Xxxxxxxxx Kennel and Farm reserves the right to deny admittance to my dog(s) at any time for any reason. ● I understand and agree that Stonehill Kennel and Farm will not be liable for any injuries or illnesses that occur as a result of my dog(s) attendance, provided that reasonable care and precautions are followed. ● I understand that group exercise and group play are situations where dogs co-mingle in groups, and if I have given permission to Stonehill Kennel and Farm to allow my dog(s) to participate in any group activity. I understand and acknowledge that there are inherent risks when dogs co-mingle, including, but not limited to, bites, scratches and sore muscles. ● I understand that Stonehill Kennel and Farm is not a veterinary establishment and does not practice veterinary medicine. I understand and agree that if my dog(s) become ill or injured, or if the state of the dog(s) health requires medical attention, Stonehill Kennel and Farm, in its sole discretion, may engage the services of a veterinarian and/or administer medicine or give other requisite attention to the dog. Stonehill Kennel and Farm staff will make their best efforts to notify me in the event of a serious illness or injury using the contact information I have provided to Stonehill Kennel and Farm. I understand that I am responsible for providing updated contact information. I agree to assume full financial responsibility for any and all expenses incurred, and I release Stonehill Kennel and Farm, and its staff from any and all responsibility for, or claims, damages, debts, arising out of or related to such medical care, including, but not limited to, transportation to/from the veterinary clinic and choice of veterinarian and animal hospital. ● I certify, to the best of my knowledge, my dog(s) has not been exposed to any communicable diseases with the past 30 days. I agree that I will notify Stonehill Kennel and Farm of any known exposure of my dog(s) to communicable diseases and will keep my dog(s) out of playcare and will provide a veterinary certification of fitness for playcare to be admitted or readmitted. I also agree that I will maintain current vaccines for my dog(s) and provide certification to that effect upon initial evaluation and periodically as requested. ● I authorize Xxxxxxxxx Xxxxxx and Farm to obtain medical and vaccination records for my dog(s) from my veterinarian, and I hereby authorize my veterinarian to provide these records to Stonehill Kennel and Farm. I understand and agree that I am solely responsible for any and all acts or behavior of my dog(s) while in the care of Stonehill Kennel and Farm. I release Stonehill Kennel and Farm from any liability arising from my dog(s) attendance at Stonehill Kennel and Farm and accept full responsibility for any and all costs for injury to staff or other animals or damage to facilities caused abide by my dog(s). I hereby release Stonehill Kennel and Farm of any liability and I further agree to indemnify and save them harmless against any and all claims arising from my dog(s) attendance at Stonehill Kennel and Farm, including but not limited to all costs, damages attorneys fees, expenses and liabilities in connection therewith. ● I understand that in an emergency event, such as a natural disaster, every effort will be made to contact me to retrieve my dog(s). I agree that Stonehill Kennel and Farm, in its sole discretion, is authorized to transport and/or make temporary alternative arrangements to house and care for my dog(s) until I retrieve my dog(s). ● I understand and agree that my dog(s) may be photographed, videotaped and/or recorded and that Stonehill Kennel and Farm retains all rights to use, and proceeds from use of, images. ● I understand that this agreement covers the current relationship between Stonehill Kennel and Farm and me.
