Common use of OWNER'S RIGHTS AND RESPONSIBILITIES Clause in Contracts

OWNER'S RIGHTS AND RESPONSIBILITIES. A. Owner's Right to Correct Deficiencies: Upon failure to perform the work in accordance with the Contract Document, including any requirements with respect to the Schedule of Completion and after five (5) days' written notice to the Contractor, the Owner may, without prejudice to any other remedy he may have, correct such deficiencies in work intended to become a permanent part of the project. The cost to correct such deficiencies may be deducted from the payment due the Contractor.
