Common use of Overdue Clause in Contracts

Overdue. Any amount due hereunder and not received by ▇▇▇▇ by the applicable due date may, in ▇▇▇▇’s discretion, be subject to an additional charge of the lesser of (a) 1.5% per month, or (b) the maximum permissible rate under applicable law, from the date due until paid. Snow reserves the right to suspend Customer’s use of the Products for which Fees are past-due until such past-due Fees are paid. Except as expressly provided in this MLSA, all Fees are nonrefundable, and payment obligations cannot be canceled or set-off.
