Overdue. The Recipient shall pay, where the account is overdue, and in addition to any amount payable, interest on that amount at the Interest Rate, in accordance with the Interest and Administrative Charges Regulation. Overdue. If payment is overdue in whole or in part in respect of any of the goods or services, or under the Customer’s credit facility with Kodak, Kodak may (without prejudice to any of its other rights): (a) not deliver any further goods or perform any further work until all monies owing and overdue to Kodak by the Customer for prior Orders and/or requests are paid to Kodak; (b) cancel any or all Orders or requests yet to be completed or fulfilled and recover from the Customer any or all losses, damages, costs, interest, fees, charges (including handling charges payable to Kodak and its suppliers) and all expenses incurred and suffered by Kodak as a result of the Customer’s default and the subsequent cancellation. The Customer shall have no recourse whatsoever against Kodak as a result of any such cancellation; or (c) recover and/or resell the goods or any of them and may use reasonable force to enter upon the Customers premises or any other place where the goods are stored by its servants or agents for that purpose (and the Customer grants to Kodak an irrevocable right and authority to so recover, re-enter and re-sell), provided that Kodak may only recover and resell for its own account sufficient of the goods (calculated at their current value) to satisfy all unpaid liability in respect of the goods, the costs of resale and any expenses (including legal expenses) incurred by Kodak in enforcing or attempting to enforce its rights. If Kodak recovers any excess, it shall not be liable in damages but shall account for the excess to the Customer. Kodak must use reasonable care in entering and removing goods, but will not be liable for any damage caused by the use of reasonable force.
