Nothing in this Agreement is intended to preclude such other business relationships. However, the Subadviser agrees that through the third anniversary of the Effective Date of this Agreement, the Subadviser will not act as a subadviser, whereby it provides a continuous investment program, to a high yield bond Fund (whether a mutual fund or a Fund offered as part of an insurance product) designed to appeal primarily to market timers or other active managers.
