Order Confirmations* and Verbal Agreements. 5.2.1. Should the Seller* be unable to fulfil an Order Confirmation* or Verbal Agreement, he shall inform SPF* immediately. SPF* shall then notify the Buyer* immediately. In such cases, the Buyer* shall be obliged to help to limit his losses by accepting delivery of weaners from alternative supplier herds* with the same health status* as the Seller's* herd, incl. any other agreed requirements and conditions. Otherwise, the Buyer's* entitlement to compensation for non-fulfilment of the agreement (as calculated in accordance with Appendix C) shall be waived.
