Common use of Operating Manual Clause in Contracts

Operating Manual. Not later than seven (7) months before the projected Xxxx Ex Service Commencement Date as set forth on the TTMS Work Schedule, Contractor shall submit for Concessionaire’s Approval a draft of the complete equipment and system instructions and procedures for the operation and maintenance of the systems and items of plant and equipment incorporated into the ETTM System. If Concessionaire does not approve the draft, it shall provide comments thereon to Contractor within thirty-five (35) days after receipt, and Contractor promptly shall incorporate or otherwise respond to Concessionaire’s comments and submit a revised draft for Concessionaire’s Approval. Such procedure shall be repeated until receipt of Concessionaire’s Approval therefor, and the revised product shall be the “Operating Manual.” Not later than fifty (50) days before the projected date of Xxxx Ex Service Commencement as set forth on the TTMS Work Schedule, Contractor shall prepare and provide the Operating Manual to the Concessionaire in a form reasonably acceptable by Concessionaire.

Not later than seven six (76) months before the projected Xxxx Ex Service Commencement Substantial Completion Date as set forth on the TTMS Work Project Schedule, Contractor shall submit for Concessionaire’s Approval a draft of the complete equipment and system instructions and procedures for the operation and maintenance of the systems and items of plant and equipment incorporated into the ETTM SystemDB Project as part of the DB Work. If Concessionaire does not approve the draft, it shall provide comments thereon to Contractor within thirty-five thirty (3530) days after receipt, and Contractor promptly shall incorporate or otherwise respond to Concessionaire’s comments and submit a revised draft for Concessionaire’s Approval. Such procedure shall be repeated until receipt of Concessionaire’s Approval therefor, and the revised product shall be the “Operating Manual.” Not later than fifty forty-five (5045) days before the projected date of Xxxx Ex Service Commencement Substantial Completion as set forth on the TTMS Work Project Schedule, Contractor shall prepare in individually numbered bound volumes and provide the deliver to Concessionaire ten (10) sets of such approved Operating Manual for the DB Project as well as one (1) set to the Department, and shall also provide each of Concessionaire and the Department the same in a an electronic form reasonably acceptable by Concessionairethat may be edited and revised electronically.
