Maintenance of Documents. All Project Documents and any other report of records that Developer is required to prepare and/or provide to the GLO pursuant to this Agreement and any other applicable regulations must be retained for the periods set out in the CDBG-DR Regulations. If no specific period is set out, such document and records must be retained for three (3) years after the end of the Term or as otherwise specified by law or required by the GLO. All Project Documents shall at all times be kept separate and identifiable from any other business of Developer that is unrelated to the Property. All Project Documents shall be maintained in compliance with the CDBG-DR Regulations and any other requirements of the State of Texas. All Project Documents shall be kept in a reasonable condition for proper audit and shall be subject to examination and photocopying during business hours by representatives of the GLO, HUD, or the United States Comptroller General. Developer agrees and acknowledges that any and all Project Documents are confidential in nature. Except as otherwise expressly required in this Agreement, the CDBG-DR Regulations, or the CDBG Multifamily Rental Housing Guidelines, Developer agrees not to disclose the Project Documents; any of the terms, provisions, or conditions thereof; or any information that relates to tenants’ or applicants’ income, social security numbers, employment statuses, disabilities, or other related matters and is deemed confidential under federal law or state law to any party outside Developer’s organization, except a professional management agent for the Project or auditors as required by third-party financing. Developer further agrees that, within its organization, the Project Documents and their confidential information will be disclosed and exhibited to only those persons within Developer’s organization whose position and responsibilities make such disclosure necessary.

Maintenance of Documents. The Office of Human Resources shall maintain copies of all position descriptions and revisions of position descriptions. All employees and the Union shall have the right to review and receive copies of any position description.

Maintenance of Documents. All books, contracts, records, computerized data, documents, and other papers relating to compliance of Owner and the Development with the Code, the QAP and with this Agreement and to the eligibility of Owner to claim Credits with respect to the Development, including but not limited to, all Resident lists, application, leases, waiting lists, Income examinations and reexaminations relating to the Development, shall at all times be maintained at the Development, or at Owner's principal place of business in the state, and shall be kept separate and identifiable from any other business of Owner which is unrelated to the Development, and shall be maintained in a reasonable condition for proper audit and subject to examination, inspection and copying during business hours by representatives of OHFA.
Maintenance of Documents. With respect to those electronically executed waivers, releases, and similar forms and instruments that AWaiver has expressly agreed to maintain on Customer’s behalf as part of the Services (the “Documents”), and provided that Customer’s account remains active and in good standing, AWaiver agrees to provide web-based technical support, training, and consulting services in a manner consistent with generally accepted industry standards and to maintain such Documents in electronic form for a period not less than seven (7) years. For so long as Customer’s account remains active and in good standing, Customer may request a copy of Customer’s Documents, in exchange for Customer’s payment of a Document retrieval fee of One Hundred Dollars ($100.00). Such requested Documents shall be delivered to Customer by AWaiver in raw database archive format (CSV and PDFs). Customer acknowledges and agrees that Customer shall be solely responsible for any fees or expenses which may be incurred by Customer in connection with extracting individual Document data from the archive formatted Documents or otherwise utilizing the archive formatted Documents. Failure of Customer to request a copy of Customer’s Documents prior to termination of Customer’s account (by either Party, for any cause or no cause) or within 30 days of termination, may result in permanent loss of Customer’s Documents and associated data.
Maintenance of Documents. CYC will provide a sample plan document to Employer if requested. CYC will use reasonable best efforts to provide updates to Employer in a timely manner after changes in the law and regulation. Employer will inform CYC of changes it desires to the Program prior to the time CYC is expected to implement those changes.
