Observation and Testing Sample Clauses

The Observation and Testing clause establishes the right for one party to monitor, inspect, or test certain goods, services, or processes to ensure compliance with agreed standards or specifications. In practice, this may involve scheduled site visits, product sampling, or performance assessments conducted by the buyer or a third party. The core function of this clause is to provide assurance of quality and adherence to contract terms, helping to identify and address issues early and thereby reducing the risk of non-conformance or defective performance.
Observation and Testing. The Contractor is responsible for construction quality control testing, cost, and reporting of the type and extent required by the contract documents. The Owner or Owner's Representative shall have the right at all times to observe and test the work. Contractor shall make necessary arrangements and provide proper facilities and access for such observation and testing at any location wherever such work is in preparation or progress. Contractor shall ascertain the scope of any observation that may be contemplated by Owner or Owner's Representative and shall give ample notice as to the time each part of the work will be ready for such observation. Owner or Owner's Representative may reject any such work found to be defective or not in accordance with the contract documents, regardless of the stage of its completion or the time or place of discovery of such errors and regardless of whether Owner's Representative has previously accepted the work. If any such work should be covered without approval or consent of the Owner, it must, if requested by Owner or Owner's Representative, be uncovered for examination at Contractor's expense. In the event that any part of the work is being fabricated or manufactured at a location where it is not convenient for Owner or Owner's Representative to make observations of such work or require testing of said work, then in such event Owner or Owner's Representative may require Contractor to furnish Owner or Owner's Representative certificates of inspection, testing or approval made by persons competent to perform such tasks at the location where that part of the work is being manufactured or fabricated. All such tests will be in accordance with the methods prescribed by the American Society for Testing and Materials or such other applicable organization as may be required by law or the contract documents. If any such work which is required to be inspected, tested, or approved is covered up without written approval or consent of the Owner or Owner's Representative, it must, if requested by the Owner or Owner's Representative, be uncovered for observation and testing at the Contractor's expense. Observation and Testing. As the On-Call Geotechnical Engineering firm for City projects, our function will be to observe and test the geotechnical aspects of the projects to confirm that they are performed/addressed in accordance with the project’s specifications, OSHA requirements and those of the other applicable regulating agencies and organizations. Our geotechnical services will typically include: observation and documentation of remedial grading, observation of slope stabilization buttress and fill key excavation; geologic mapping of excavation backcuts; observation and testing of placement and compaction of fill; observation and testing of utility trench excavation and backfill; observation and testing of retaining wall backfill; foundation footing observation; observation and testing of placement and compaction of street, curb, gutter and sidewalk subgrade and aggregate base; observation and testing of placement and compaction of street asphaltic concrete. Asphalt temperature, mix designs, and placement timing are also checked and documented by our office. Special Inspection observation and materials testing services will be provided for the concrete and steel reinforcement for the proposed structures. Our services will also include laboratory testing of the backfill and pavement section materials including; sand equivalent, maximum dry density and moisture content, and sieve analysis. Our services will be provided in accordance with the project specifications and the City’s requirements. Our field Geologist, Senior Field Technician and Special Inspector for concrete and steel will be on site as needed and appropriate to perform geologic mapping, documentation, observation and testing for our firm. They will be in constant communication with our project manager in the office and with the City’s Representative and project Construction Manager so that progress, scope, and schedule can be tracked and regularly updated. Observation and Testing. A. Prior to the scheduled observation, remove all dust, spent abrasive, and foreign material from the surface to be coated. B. The Contractor is to furnish an instrument for measuring the wet film thickness, and also a calibrated instrument for measuring dry film thickness of each field coat of paint. The dry film thickness testing gauge shall be the magnetic type as manufactured by Elcometer Co., or the Nordson Gauge Co.; spring loaded model with two percent (2%) accuracy margin over a range of one-to-twenty-one (1-100) mils or equal. Observation and Testing. Observation and testing shall consist of visual observation of earthwork activities and taking field density and moisture tests for the purpose of ascertaining that the work is in substantial conformance with the contract documents. Such observation and testing shall not be relied upon by others as acceptance of the work nor shall it be construed to relieve the contractor in any way from the contractor’s obligation and responsibilities under the construction contract. Specifically, but without limitations, observation and testing shall not require the technician and engineer to assume responsibilities for the means and methods of construction nor for safety on the job site.
