Notice of Commissioning Decision. 4.1 The BBC will give the Company written notice of the BBC’s decision to either commission further development work (which may include a pilot whether or not transmittable) which will be evidenced under a separate Development Agreement, as Side Letter extending the existing Development Agreement, or commission production of the Programme within 6 months of Acceptance (defined below) of the Development Work, unless such time period is extended by agreement in writing between the parties (“Development Period”).
