Common use of Nonconformance Clause in Contracts

Nonconformance. Products or services that do not conform to the requirements of this Agreement may be rejected, at ▇▇▇▇▇▇ Scientific’s sole option. All costs with respect to the repair, replacement or refund of the nonconforming Products, including packing, packaging and freight charges, will be at the Supplier’s expense. With respect to freight charges, nonconformance also applies to Supplier selection of unauthorized carriers and/or unauthorized modes of transport.
