NO WAIVER OF GOVERNMENTAL IMMUNITY ACT. The parties hereto understand and agree that the County, its commissioners, officials, officers, directors, agents and employees, are relying on, and do not waive or intend to waive by any provisions of this Contract, the monetary limitations or any other rights, immunities and protections provided by the Colorado Governmental Immunity Act, §§ 00-00-000 to 120, C.R.S., or otherwise available to the County.
NO WAIVER OF GOVERNMENTAL IMMUNITY ACT. The Parties hereto understand and agree that DHS, its commissioners, officials, officers, directors, agents and employees, are relying on, and do not waive or intend to waive by any provisions of this Contract, the monetary limitations or any other rights, immunities and protections provided by the Colorado Governmental Immunity Act,§§ 00-00-000 to 120, C.R.S., or otherwise available to DHS.
NO WAIVER OF GOVERNMENTAL IMMUNITY ACT. The Parties hereto understand and agree that the City, its elected officials, directors, agents and employees, are relying on, and do not waive or intend to waive by any provisions of this Agreement, the monetary limitations or any other rights, immunities and protections provided by the Colorado Governmental Immunity Act, §§ 00-00-000, et seq., C.R.S., as the same may be amended from time to time, or otherwise available to the City.
NO WAIVER OF GOVERNMENTAL IMMUNITY ACT. The parties hereto understand and agree that the respective Counties and Cities, their commissioners, officials, officers, directors, agents, and employees, are relying on, and do not waive or intend to waive by any provisions of this Agreement, the monetary limitations or any other rights, immunities and protections provided by the Colorado Governmental Immunity Act (the “CGIA”), § 00-00-000 to 120, C.R.S., or otherwise available). To the extent the CGIA imposes varying obligations or contains different waivers of immunity the parties agree that each will remain liable for its independent obligations under the CGIA, and neither party shall be the agent of the other or liable for the obligations of the other. No party shall be liable under this Agreement for the actions of the other’s employees and agents. By agreeing to this provision, the parties do not waive or intend to waive, the limitations on liability which are provided to parties under the Colorado Governmental Immunity Act, C.R.S §§00-00-000, et seq.

The Parties hereto understand and agree that they, their commissioners, officials, officers, directors, agents, and employees, are relying on, and do not waive or intend to waive by any provisions of this Agreement, the monetary limitations or any other rights, immunities and protections provided by the Colorado Governmental Immunity Act (the “CGIA”), §§ 00-00-000 to 120, C.R.S., or otherwise available to the County or the Jurisdiction. To the extent the CGIA imposes varying obligations or contains different waivers for cities and counties, both the Jurisdiction and the County agree that they will remain liable for their independent obligations under the CGIA, and neither party shall be the agent of the other or liable for the obligations of the other.

The Parties hereto understand and agree that the City and the County, their respective council members, commissioners, officials, officers, directors, agents, and employees, are relying on, and do not waive or intend to waive by any provisions of this Agreement, the monetary limitations or any other rights, immunities and protections provided by the Colorado Governmental Immunity Act (the “CGIA”), § 00-00-000 to 120, C,R.S., or otherwise available to the County or the City. To the extent the CGIA imposes varying obligations or contains different waivers of immunity for cities and counties, both the City and the County agree that each will remain liable for their independent obligations under the CGIA, and neither party shall be the agent of the other or liable for the obligations of the other.

The parties hereto understand and agree that the Town and the County, its council members, commissioners, officials, officers, directors, agents and employees, are relying on, and do not waive or intend to waive by any provisions of this Agreement, the monetary limitations or any other rights, immunities and protections provided by the Colorado Governmental Immunity Act, §§ 00-00-000 to 120, C.R.S., or otherwise available to the Town or County.
NO WAIVER OF GOVERNMENTAL IMMUNITY ACT. The Parties hereto understand and agree that the Parties, their commissioners, officials, officers, directors, agents and employees, are relying on, and do not waive or intend to waive by any provisions of this Agreement, the monetary limitations or any other rights, immunities and protections provided by the Colorado Governmental Immunity Act, §§ 00-00-000 to 120, C.R.S., or otherwise available to the County.
NO WAIVER OF GOVERNMENTAL IMMUNITY ACT. The Parties hereto understand and agree that the Customer, its commissioners, officials, officers, directors, agents and employees, are relying on, and do not waive or intend to waive by any provisions of this Agreement, the monetary limitations or any other rights, immunities and protections provided by the Colorado Governmental Immunity Act, §§ 24-10- 101 to 120, C.R.S., or otherwise available to the Customer.

The Parties hereto understand and agree that the County, DHS, its commissioners, officials, officers, directors, agents and employees, are relying on, and do not waive or intend to waive by any provisions of this Agreement, the monetary limitations or any other rights, immunities and protections provided by the Colorado Governmental Immunity Act, §§ 00-00-000 to 120, C.R.S., or otherwise available to the County or DHS.
