No Multiemployer Plans. At no time has either of the Sellers or any member of the Group sponsored, maintained, contributed to, had any obligation to contribute to, or incurred, or expects to incur, any liability regarding any multiemployer plan (as defined in Section 3(37) or Section 4001(a)(2) of ERISA).
No Multiemployer Plans. No ERISA Plan is a "multiemployer pension plan," as defined in section 3(37) of ERISA, nor is any ERISA Plan a plan described in section 4063(a) of ERISA.
No Multiemployer Plans. Neither the Company nor any ERISA Affiliate has contributed to or been obligated to contribute to a “multiemployer plan” (as defined in Section 4001(a)(3) of ERISA) during the past five years.
No Multiemployer Plans. The Seller (i) has never contributed to a multi-employer pension plan; and (ii) has never incurred any liability under Title IV of ERISA to the PBGC or to a multi-employer pension plan.
No Multiemployer Plans. Kevlxx xxx never had any obligation to contribute to any multiemployer plan within the meaning of section 3(37) or 4001(a)(3) of ERISA with respect to any of its employees. Kevlxx xx not and could not become subject to any withdrawal liability within the meaning of section 4201 of ERISA with respect to any multiemployer plan. Kevlxx xxx never been a substantial employer within the meaning of section 4001(a)(2) of ERISA with respect to any single-employer plan within the meaning of section 4001(a)(15) of ERISA for which an employer could incur liability under section 4063 or 4064 of ERISA. No Multiemployer Plans. Neither the Company nor any ERISA Affiliate thereof contributes to or is obligated to contribute, to any Multiemployer Plan or has contributed, or had an obligation to contribute, to any such plan during the six-year period ending on the Closing Date.
No Multiemployer Plans. Neither Sterling nor any Sterling Controlled Group Member has ever sponsored or contributed to, or had an obligation to contribute to, a Multiemployer Plan as such term is defined in Section 4001(a)(3) of ERISA.
No Multiemployer Plans. At no time has the Company or any of its Affiliates contributed to or been requested to contribute to any Employer Plan that is a "multiemployer plan" as defined in Section 3(37) of ERISA.
No Multiemployer Plans. Except as disclosed on Exhibit 4.18, neither the Corporation nor the Subsidiary is a contributing employer under or has any actual or potential liability to any "multiemployer plan", as that term is defined in Section 3(37) of ERISA.
No Multiemployer Plans. The Company (a) has never contributed to a multi-employer pension plan; and (b) has never incurred any liability under Title IV of ERISA to the PBGC or to a multi-employer pension plan.
