No Condemnation or Casualty. Except in connection with a Credit Facility Termination Request, there shall not be pending or threatened any condemnation or other taking, whether direct or indirect, against any Mortgaged Property and there shall not have occurred any casualty to any improvements located on any Mortgaged Property, which casualty would have a material adverse effect on the continued operations of such Mortgaged Property.

The Property has not suffered a Condemnation or a Casualty or any other damage or destruction which renders the Property unusable in whole or in material part, and, under applicable Law, the Property may be used for the purposes contemplated by the Company in accordance with the Lease.
